PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. All the facts and circumstances pertaining to the applicant’s
discharge process are not in the available records. On 28 November 2001,
DA, HQ, U.S. Army Medical Department Center & School, Fort Sam Houston,
Texas, Orders 332-0115 discharged the applicant from the Regular Army,
effective date 5 December 2001. The record also contains a properly
constituted DD Form 214 (Certificate of Release or Discharge From Active
Duty), which was not authenticated by the applicant’s signature since he
was not available for signature. His DD Form 214 indicates that he was
involuntarily discharged under the provisions of Chapter 7, AR 635-200 by
reason of fraudulent entry, with a characterization of service of
uncharacterized, a separation code of JDA, and an RE code of 3.
b. On 5 December 2001, the applicant was discharged. At the time of
discharge, the applicant had completed 1 year, 10 months, and 6 days of
active military service in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 7 of that regulation provides, in pertinent part, that a fraudulent
entry is the procurement of an enlistment, reenlistment, or period of
active service through any deliberate material misrepresentation, omission,
or concealment of information which if known and considered by the Army at
the time of enlistment or reenlistment, might have resulted in rejection,
including all disqualifying information requiring a waiver. Soldiers
separated under this chapter may be awarded an honorable discharge, or a
general discharge, or a discharge under other than honorable conditions.
If in an entry level status the characterization will be uncharacterized.

(2) The issue is accepted. The Board carefully examined the
available record of service during the period of enlistment under review
and heard his testimony. The Board found that the applicant provided
convincing testimony about the circumstances surrounding his recruitment
and subsequent discharge from the Army. In addition, the Board noted that
the applicant served honorably for more than a year prior to his
involuntary separation. Given the foregoing, the Board determined that the
applicant had service of sufficient merit to overcome the type of discharge
granted. Accordingly, the Board voted to change the characterization of
service to fully honorable and to change the reason for discharge to
Secretarial Authority. This action does not include a change in RE code.
