THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, the removal of two erroneously filed Meritorious Unit Commendation (MUC) certificates from his official military personnel file (OMPF).    

2.  The applicant states, in effect, the two awards were erroneously submitted by his unit's personnel section and were uploaded into the interactive Personnel Electronic Records Management System (iPERMS).  He states he was never assigned to the units, which were subordinate units of the 1st Sustainment Brigade to which he is assigned.  Permanent Order 065-08, dated 6 March 2013, awarded 7 subordinate units of the 1st Sustainment Brigade the MUC for service from 29 April 2010 to 14 April 2011.         

3.  The applicant provides:

* an email from the U.S. Army Human Resources Command (HRC) assigning an iPERMS problem case number 
* a copy of a MUC Certificate, dated 6 March 2013, showing the MUC was awarded to Detachment, 376th Finance Company, for the period 29 April 2010 to 25 October 2010
* a copy of a MUC Certificate, dated 6 March 2013, showing the MUC was awarded to Company C, 208th Finance Company, for the period 29 April 2010 to 25 October 2010   



CONSIDERATION OF EVIDENCE:

1.  The applicant is a Regular Army Soldier serving in the rank/grade of sergeant first class (SFC)/E-7.  On or after 1 July 2010, he was assigned to Headquarters and Headquarters Company (HHC), 1st Sustainment Brigade, Fort Riley, Kansas, which was later redesignated as HHC, Special Troops Battalion, 1st Sustainment Brigade, at Fort Riley.  

2.  A review of the applicant's performance folder in his OMPF shows it contains:

     a.  Permanent Order 065-08, dated 6 March 2013, which awarded the MUC to the following units for exceptionally meritorious service during the period 29 April 2010 to 14 April 2011:

* HHC, 1st Sustainment Brigade
* Signal Company, 1st Sustainment Brigade
* 138th Finance Detachment (20 June 2010 to 2 April 2011)
* Detachment, 82d Finance Company (29 April to 26 November 2010) 
* Detachment, 376th Finance Company (29 April to 25 October 2010)
* Company C, 208th Finance Company (29 April to 29 October 2010)
* Detachment, 376th Personnel Company (14 July to 14 April 2011) 

     b.  A MUC Certificate, dated 6 March 2013, showing the MUC was awarded to HHC, 1st Sustainment Brigade, in accordance with Permanent Orders 065-08. 

     c.  A MUC Certificate, dated 6 March 2013, showing the MUC was awarded to Detachment, 376th Finance Company, for meritorious service in support of military operations for the period 29 April to 25 October 2010

     d.  A MUC Certificate, dated 6 March 2013, showing the MUC was awarded to Company C, 208th Finance Company, for meritorious service in support of military operations for the period 29 April to 29 October 2010 

3.  The record is void of any documentation that shows he was assigned to either the 376th or 208th Finance Companies.  

4.  The applicant provides an email from HRC that states the only way to have a document removed from his record is to petition this agency for removal.    

5.  Army Regulation (AR) 600-8-104 (Military Personnel Information Management/Records) prescribes the policies and mandated operating tasks for the Military Personnel (MILPER) Information Management/Records Program of the Military Personnel System.  It states that, once placed in the OMPF, a document becomes a permanent part of that file.  The document will not be removed from a fiche or moved to another part of the fiche unless directed by the Army Board for Correction of Military Records (ABCMR).

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends the two MUC Certificates should be removed from his OMPF since he was not assigned to either of the two awarded units.  His contention was carefully considered.     
  
2.  The evidence of record confirms he was assigned to only the 1st Sustainment Brigade during the award period cited in the MUC awards.  It is reasonable that the brigade's personnel section erroneously submitted the certificates for uploading into iPERMS.  

3.  In view of the foregoing, it would be appropriate to remove the two MUC Certificates in question from the performance folder of his OMPF.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: 

* removing the MUC Certificate, dated 6 March 2013, showing the MUC was awarded to Detachment, 376th Finance Company, for the period 
29 April 2010 to 25 October 2010





* removing the MUC Certificate, dated 6 March 2013, showing the MUC was awarded to Company C, 208th Finance Company, for the period 
29 April 2010 to 29 October 2010
