THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests removal of the award of the Meritorious Unit Commendation (MUC) for the period 29 November 2006 to 10 January 2008 from his Official Military Personnel file (OMPF).

2.  The applicant states he served with the 115th Brigade Support Battalion (BSB), 1st Brigade Combat Team (BCT), 1st Cavalry Division during the Iraq combat tour of 2006-2008.  The subject award of the MUC in his OMPF is for the Brigade Special Troops Battalion (BSTB), 1st BCT, 1st Cavalry Division during the Iraq combat tour of 2006-2008.

3.  The applicant provides copies of General Orders Number 2013-85, Department of the Army, dated 12 November 2013.

CONSIDERATION OF EVIDENCE:

1.  The applicant is currently serving in the Regular Army in the rank of captain, pay grade O-3.  His OMPF contains the following documents:

	a.  A DA Form 67-9 (Officer Evaluation Report) for the rated period from 22 February 2007 to 21 February 2008, showing the applicant was assigned to the 115th BSB, 1st BCT, 1st Cavalry Division.

	b.  General Orders Number 2013-85, Department of the Army, dated 12 November 2013, which amended the MUC as described in the applicant’s statement.  

2.  Army Regulation 600-8-104 (Army Military Human Resource Records Management) provides the following:

	a.  All personnel information recorded under the authority of this regulation is the property of the U.S. Government.  Once recorded, it will not be removed except as provided by law or this regulation.

	b.  Once placed in the OMPF, the document becomes a permanent part of that file.  The document will not be removed from the OMPF unless directed by one or more of several listed agencies, including this Board.

DISCUSSION AND CONCLUSIONS:

The available evidence clearly shows the applicant was assigned to a unit different from that shown in the subject general orders at the time in question.  Therefore, it would be appropriate to remove the general orders in question from his OMPF.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing from his OMPF General Orders Number 2013-85, Department of the Army, dated 12 November 2013.
