THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests removal of Headquarters, 35th Engineer Battalion, 1st Engineer Brigade, U.S. Army Engineer School, Permanent Order 336-02, dated 2 December 2013, for award of the Army Good Conduct Medal (AGCM) (3rd Award) from his Army Military Human Resource Record (AMHRR).

2.  The applicant states the S-1 made a minor mistake by miscalculating his time in service, which is 12 years.
 
3.  The applicant provides:

* orders for the first and second award of the AGCM
* two orders for the third award of the AGCM
* orders for a fourth award of the AGCM

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 21 June 2001.  He is currently serving on active duty in the rank of staff sergeant.

2.  He provided Detachment A, 22d Personnel Services Battalion,
 Orders 278-040, dated 4 October 2004, showing he was awarded the AGCM (1st Award) for the period 21 June 2001 to 20 June 2004.

3.  He provided Headquarters and Headquarters Company, U.S. Army Europe and 7th Army, Order 232-016, dated 19 November 2007, showing he was awarded the AGCM (2nd Award) for the period 21 June 2004 to 20 June 2007.

4.  He provided Headquarters, Allied Forces North Battalion, Permanent Orders 302-04, dated 29 October 2010, showing he was awarded the AGCM (3rd Award) for the period 21 June 2007 to 20 June 2010.  These orders are not filed in his AMHRR in the interactive Personnel Electronic Records Management System (iPERMS).

5.  He provided Headquarters, 35th Engineer Battalion, 1st Engineer Brigade, U.S. Army Engineer School, Permanent Order 336-01, dated 2 December 2013, showing he was awarded the AGCM (4th Award) for the period 29 November 2010 to 29 November 2013.

6.  He provided Headquarters, 35th Engineer Battalion, 1st Engineer Brigade, U.S. Army Engineer School, Permanent Order 336-02, dated 2 December 2013, showing he was awarded the AGCM (3rd Award) for the period 29 November 2010 to 29 November 2013.  There is no evidence these orders have been revoked.

7.  A review of the applicant's AMHRR in iPERMS revealed a copy of Headquarters, 35th Engineer Battalion, 1st Engineer Brigade, U.S. Army Engineer School, Permanent Order 336-02, dated 2 December 2013.

8.  Army Regulation 600-8-104 (Army Military Human Resource Records Management) prescribes Army policy for the creation, utilization, administration, maintenance, and disposition of the AMHRR.  It states the purpose of the AMHRR is to preserve permanent documents pertaining to enlistment, appointment, duty stations, assignments, training, qualifications, performance, awards, medals, disciplinary actions, insurance, emergency data, separation, retirement, casualty, administrative remarks, and any other personnel actions.

9.  Army Regulation 600-8-104, appendix B (Documents Authorized for Filing in the Army Military Human Resource Record and/or iPERMS), states award orders will be filed in the performance and service folders of the AMHRR.

DISCUSSION AND CONCLUSIONS:

1.  The regulatory guidance states to file award orders in the AMHRR.

2.  However, there is a viable reason for revoking and removing Headquarters, 35th Engineer Battalion, 1st Engineer Brigade, U.S. Army Engineer School, Permanent Order 336-02, dated 2 December 2013, from the applicant's AMHRR.  These orders are a duplicate award of the AGCM (3rd Award) for what appears to be the same period as his fourth award of the AGCM.  These orders offer no relevant information regarding the applicant's service, conduct, or duty performance.  Moreover, revoking and removing them would eliminate the potential for confusion by officials authorized to review the performance folder of the applicant's AMHRR.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  revoking Headquarters, 35th Engineer Battalion, 1st Engineer Brigade, U.S. Army Engineer School, Permanent Order 336-02, dated 2 December 2013;

	b.  removing Headquarters, 35th Engineer Battalion, 1st Engineer Brigade, U.S. Army Engineer School, Permanent Order 336-02, dated 2 December 2013, from his AMHRR; and

	c.  ensuring the revocation orders are not filed in his AMHRR.
