THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests his college transcript from Summit University of Louisiana be removed from his Army Military Human Resource Record (AMHRR).

2.  The applicant states the Council on Higher Education Accrediting does not accept his degree from Summit University as of 12 January 2011.

3.  The applicant provides his Summit University official transcript of academic record.

CONSIDERATION OF EVIDENCE:

1.  On 2 July 1993, he enlisted in the Regular Army.  He immediately reenlisted on 18 September 1996, 10 November 1999, 29 November 2001, and 
12 February 2008.  

2.  On 30 January 2002, the applicant was awarded a Bachelor of Science degree in Management by Summit University, New Orleans, LA.  The Official Transcript of Academic Record documenting this degree was filed in the applicant's AMHRR on 3 September 2002. 

3.  He was promoted to sergeant first class (SFC)/pay grade E-7 on 1 December 2004 and to master sergeant (MSG)/pay grade E-8 on 1 October 2008.

4.  Summit University, New Orleans, LA, is not listed as an accredited university on the Department of Education website at http://ope.ed.gov.

5.  On 15 April 2010, Military Personnel Message Number 10-109 announced the procedures for removal of fraudulent diplomas or transcripts from a Soldier's AMHRR.  Soldiers were required to submit their request to have a transcript removed through their chain of command to the appropriate authority, which in this case was the U.S. Army Human Resources Command (HRC).

6.  Army Regulation 600-8-104 (Military Personnel Information Management/Records) governs the composition of the AMHRR, and states that the performance section is used for filing performance, commendatory and disciplinary data.  Once placed in the AMHRR, the document becomes a permanent part of that file.  The document will not be removed from or moved to another part of the AMHRR unless directed by certain agencies, to include this Board.  Army Regulation 600-8-104 states that all enlisted Soldiers’ transcripts of credit from civilian colleges, universities, trade schools, or business schools are filed in the Performance section of the AMHRR.

DISCUSSION AND CONCLUSIONS:

1.  Summit University is not an accredited university according to the Department of Education.  The applicant submitted his transcript from this university and it was included on his AMHRR on 3 September 2002.

2.  He subsequently was selected for promotion to SFC and MSG with this transcript available for review by promotion boards.

3.  There is no evidence he attempted to have the transcript removed through his chain of command in accordance with MILPER Message Number 10-109.

4.  Notwithstanding that Army Regulation 600-8-104 provides only for filing accredited transcripts in the AMHRR, for historical purposes, the Army has an interest in maintaining the accuracy of its records.  The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created.  Therefore, based on fact that these transcripts were in his AMHRR when it was reviewed for two promotions there is not a sufficiently compelling reason for compromising the integrity of the Army’s records.

5.  In view of the above, there is an insufficient basis to remove the transcript from his AMHRR at this time.
