Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of an Almeda College and University transcript from his Army Military Human Resource Record (AMHRR), formerly known as the Official Military Personnel File. 2. The applicant states the transcript was added to his file in 2004. He states he was not aware the transcript was not from an accredited school until he was notified by the U.S. Army Sergeants Major Academy on 22 February 2014. 3. The applicant provides no additional documentation. CONSIDERATION OF EVIDENCE: 1. The applicant was awarded a Bachelor of Science degree in Business Administration by Almeda College and University on 30 January 2004 and the transcript was posted to his AMHRR in June 2004. He was a Regular Army sergeant first class/pay grade E-7 at the time. 2. He was promoted to master sergeant/pay grade E-8 effective 1 October 2007. 3. Almeda College and University is not listed as an accredited university on the Department of Education website at http://ope.ed.gov/accreditation. 4. A review of his official records failed to show any evidence of the applicant submitting a request for removal of the transcript from his official records through his chain of command. 5. On 15 April 2010, Military Personnel (MILPER) Message Number 10-109 announced the procedures for removal of fraudulent diplomas or transcripts from a Soldier’s AMHRR. It provided, in pertinent part, that Soldiers were required to submit their request to have a transcript removed through their chain of command to the appropriate authority, which in this case is the U.S. Army Human Resources Command. 6. Army Regulation 600-8-104 (Military Personnel Information Management/ Records) governs the composition of the AMHRR. It states that all enlisted Soldiers’ transcripts of credit from civilian colleges, universities, trade schools, or business schools are filed in the performance section in the AMHRR. Transcripts must be from an accredited college or university as verified by the Department of Education to be filed in the AMHRR. Once placed in the AMHRR, the document becomes a permanent part of that file. The document will not be removed from or moved to another part of the AMHRR unless directed by certain agencies, to include this Board. DISCUSSION AND CONCLUSIONS: 1. Almeda College and University is not an accredited university according to the Department of Education. The applicant submitted his transcript from this institution and it was included in his AMHRR in June 2004. 2. He was subsequently selected for promotion to MSG with this transcript available for review by promotion boards. 3. There is no evidence he attempted to have the transcript removed in accordance with the procedures outlined in MILPER Message 10-109. 4. Notwithstanding that Army Regulation 600-8-104 provides only for filing accredited transcripts in the AMHRR, for historical purposes, the Army has an interest in maintaining accuracy of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. Therefore, based on the fact that this transcript was in his AMHRR when his file was reviewed for promotion there is an insufficiently compelling reason for compromising the integrity of the Army's records. 5. In view of the foregoing, there is an insufficient basis for granting the applicant's request.
