		IN THE CASE OF:

		BOARD DATE: 24 June 2014

		DOCKET NUMBER: AR20130018889

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Bronze Star Medal and to delete the Meritorious Service Medal.

2. The applicant states his DD Form 214 indicates he was awarded the Meritorious Service Medal but this is an error. His award of the Meritorious Service Medal was upgraded to the Bronze Star Medal after he was released from active duty. It arrived at his U.S. Army Reserve (USAR) unit 3 months later and until then he had been unaware the award had been upgraded.

3. The applicant provides his DD Form 214, orders, an award citation, and two DA Forms 638 (Recommendation for Award).

CONSIDERATION OF EVIDENCE:

1. The applicant entered active duty as a member of his USAR unit on 23 October 2009 in support of Operation Enduring Freedom. He served in Afghanistan from 21 December 2009 to 19 October 2010.

2. Permanent Orders (PO) 257-051, dated 14 September 2010, issued by Headquarters (HQ), Combined Joint Task Force (CJTF) - 101, awarded him the Meritorious Service Medal.

3. The applicant provides and his record contains the following PO, issued by HQ, CJTF-100:
* PO 309-094, dated 6 November 2010, awarding him the Bronze Star Medal
* PO 309-095, dated 6 November 2010, revoking PO 257-051, dated 14 September 2010

4. He was honorably released from active duty on 3 December 2010 to the control of his USAR unit.

5. The DD Form 214 he was issued shows, in part, the Meritorious Service Medal but not the Bronze Star Medal.

DISCUSSION AND CONCLUSIONS:

The evidence of record confirms PO awarded the applicant the Bronze Star Medal which is not shown on his DD Form 214. In addition, the record confirms PO revoked his award of the Meritorious Service Medal. Therefore, he is entitled to the correction of his DD Form 214 accordingly.

BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:

As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 3 December 2010 by deleting the Meritorious Service Medal and adding the Bronze Star Medal.

It stated Reserve Component (RC) Soldiers mobilized to active duty under Title 10 are performing "active Federal military service" and are therefore eligible to be awarded the AGCM. Award of the ARCAM requires the individual to complete 3 years of exemplary service in either the USAR or ARNG; however, the time served on active duty is not credited toward that 3-year period and the eligibility period starts the day after completion of active duty. As a result, the Board recommends denial of...
