		BOARD DATE: 6 May 2014

		DOCKET NUMBER: AR20130015510

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show a primary specialty of 35F1O – Tactical Intelligence Analyst in item 11 (Primary Specialty).

2. The applicant states that he was discharged due to a knee injury before he could complete his advanced individual training (AIT). He continues by stating that he actually completed his AIT but could not pass a physical fitness test. He also states that having the military occupational specialty (MOS) on his DD Form 214 would help him in gaining employment.

3. The applicant provides copies of his DD Form 214, college transcripts, and his Department of Veterans Affairs Rating Decision.

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in the Regular Army on 24 March 2011 for a period of 3 years and 27 weeks and training as a tactical intelligence analyst (35F1O).

2. He completed his basic training at Fort Jackson, South Carolina and was transferred to Fort Huachuca, Arizona to undergo his AIT in MOS 35F1O.

3. On 21 November 2011, he was honorably discharged due to unsatisfactory performance. He had served 7 months and 28 days of active service and had not completed his AIT and thus was not awarded an MOS.

4. Army Regulation 635-5 at the time served as the authority for the preparation of the DD Form 214. It provided, in pertinent part, that only completed courses that are 1 week (40 hours) or more in duration will be entered on the DD Form 214.

DISCUSSION AND CONCLUSIONS:

1. The applicant’s contentions and supporting documents have been noted and found to lack merit.

2. Notwithstanding the circumstances, the applicant did not complete his AIT and was not awarded a primary MOS.

3. Accordingly, he is not eligible to have completion of his AIT or an MOS added to his DD Form 214 as there is no eror or injustice in his case.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

__X______ __X______ _X__ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

The applicant requests her DD Form 214 (Certificate of Release or Discharge from Active Duty) be amended. The records clearly show the applicant's MOS was 35M, HUMINT Collector, not Radar Repairer (MOS 94M). As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending her DD Form 214 to show the applicant's military education as 35M - Human Intelligence (HUMINT) Collector Course, 18 weeks and 3 days, 2011.

The same regulation states to list in-service (full-time attendance) training courses successfully completed during the period of service in item 14 of the DD Form 214. Her request to have MOS 91C added to item 11 and the Practical Nurse Course to item 14 of her DD Form 214 was carefully considered. Both conversion periods were prior to the applicant’s retirement from the Army and accordingly, her MOS was converted during each period.

There is no evidence in his records to show that he ever served as a HUMINT Collector. While the applicant served 1 year in a TPU after his REFRAD, he is not entitled to have that service included on his DD Form 214 as it was not active duty service and it occurred after the DD Form 214 was issued. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: * deleting the entry “94M2O RADAR REPAIRER – 1 YRS 10 MOS//35M1O HUMINT...
