THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) rendered for the period ending 31 December 1990 to show his primary military occupational specialty (PMOS) was a Traffic (i.e., Transportation) Management Coordinator rather than a Motor Transport Operator.

2.  The applicant states, in effect, item 11 (Primary Specialty) of his DD Form 214 is incorrect.

3.  The applicant provides two copies of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, 


has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  Records show the applicant enlisted in the Army on 8 September 1969.  He completed training and was awarded MOS 71N (Transportation Management Coordinator).   The highest rank/grade he attained while serving on active duty was sergeant first class/E-7.  

3.  Records show the applicant served several periods of enlistment prior to his retirement.  He was issued a DD Form 214 (Report of Separation from Active Duty) on 12 July 1977 showing his PMOS as 71N2B (Traffic Management Coordinator). 

4.  His DA Form 2-1 (Personnel Qualification Record), item 35 (Record of Assignments) shows the applicant's MOS converted to 88N (Transportation Management Coordinator) and he held this MOS until his retirement.

5.  The applicant provides two copies of his DD Form 214 for the period ending 31 December 1990 which shows two different MOSs, 88N4O (Motor Transport Operator) and 88N4O (Traffic Management Coordinator).

6.  Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed policies and procedures regarding separation documents.  Section II provided for completion of the DD Form 214.  When completing Item 11, the preparer was required to enter the appropriate number, title and years and months in specialty as shown on the separating Soldier's DA Form 2-1.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's request that his DD Form 214 be corrected to show his correct MOS as 88N4O was carefully considered and determined to have merit.

2.  The evidence of record shows the applicant's MOS was 88N4O (Transportation Management Coordinator) not "Traffic Management Coordinator" or "Motor Transport Operator."  His MOS remained "Transportation Management Coordinator" until his retirement.  Therefore, his DD Form 214 should be corrected to reflect this fact.
