		IN THE CASE OF:

		BOARD DATE: 14 June 2011

		DOCKET NUMBER: AR20100029283

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of the service entry date shown on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge).

2. The applicant states that his DD Form 214 reflects that he was discharged before he entered active duty and he needs this form corrected for social security benefits purposes.

3. The applicant provides a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2. The applicant enlisted in the U.S. Army Reserve (USAR) in Faribault, Minnesota, for a period of 6 years on 19 July 1967.

3. He was ordered to active duty for training (ACDUTRA) on 16 November 1967 and was transferred to Fort Bragg, North Carolina, to undergo basic training. He completed basic training and was transferred to Aberdeen Proving Ground, Maryland, to undergo advanced individual training (AIT) as an engine and powertrain repairman.

4. He completed AIT and was honorably released from ACDUTRA on 12 May 1968. He completed 5 months and 27 days of ACDUTRA and was returned to his USAR unit in Minnesota.

5. His DD Form 214 issued at the time of his release from ACDUTRA shows in block 17c (Date of Entry) that he entered ACDUTRA on 16 November 1968.

DISCUSSION AND CONCLUSIONS:

1. The applicant's contention has been noted and was found to have merit. The applicant entered ACDUTRA on 16 November 1967 and served on active duty until he was released from ACDUTRA on 12 May 1968.

2. However, his DD Form 214 issued at the time of his release from ACDUTRA reflects that he entered ACDUTRA on 16 November 1968, a year later than the actual date.

3. Accordingly, his DD Form 214 should be corrected to reflect that he entered ACDUTRA on 16 November 1967.

BOARD VOTE:

__X_____ __X_____ ___X____ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

1. The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* deleting the entry from block 17c of his DD Form 214
* adding the entry 16 November 1967 to block 17c of his DD Form 214

2. The Board wants the applicant and all others to know the sacrifices he made in service to the United States are deeply appreciated. The applicant and all Americans should be justifiably proud of his service in arms.

    (h) Item 30: Enter "This abbreviated form issued to Army National Guard members per appendix A, this AR [Army Regulation]" on all abbreviated DD Forms 214 issued. Noncontinuous periods of active duty are summarized on separate DD Forms 214; therefore, there is no basis for granting the applicant's request to amend his existing DD Form 214 to include the second period of activation from 7 April 1968 to 11 April 1968. His activation orders, issued by the XX United States Army Corps, specifically state that he was being ordered to active duty for the purpose of training (ACDUTRA). Again the orders specifically state the applicant was being ordered to active duty for the purpose of training. It is clear, based on the various documents which ordered the applicant to active duty, that his final period of active service, 28 September 1968 through 27 April 1969, was not for the purpose of training but rather...

The applicant requests, in effect, correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the correct date of entry into active duty. The applicant provides a DD Form 214 and U.S. Army Reserve (USAR) discharge orders, dated 19 March 1974, in support of this application. It is evident there is an error in the applicant's DD Form 214.

On 17 March 1971 he was discharged under other than honorable conditions under the provisions of Army Regulation 635-206 due to conviction by civil authorities. Army Regulation 635-200, paragraph 3-7b, provides that a general discharge is a separation from the Army under honorable conditions. The applicant's overall record of service has been considered.

The evidence of record shows that the applicant entered active duty for training on 29 March 1967 and was honorably released from active duty on 29 July 1967. His DD Form 214 correctly shows the dates of entry and separation and the net period of active service. It appears that the applicant’s periods of service documented on the NA Form 13041 were performed as part of his USAR training obligation and could not be entered on the DD Form 214 as they occurred outside the period covered by...

Item 22a(1) properly shows the total amount of service completed between 28 June 1968 (inclusive date of current tour of duty) through 24 August 1973, a period of 5 years, 1 month, and 27 days. Item 22a(2) properly shows the total amount of service in the USAR DEP (2 June to 10 September 1967) and enlisted time from 11 September 1967 to 27 June 1968. The evidence of record he served in an enlisted status from 11 September 1967 through 27 June 1968.

The applicant provides his DD Form 214. His DD Form 214 shows he completed 4 months of active service. He entered active duty for training on 27 July 1968 and this date is correctly listed in item 17c of his DD Form 214.

The applicant states, in effect, that his DD Form 214 dated 26 March 1971 incorrectly reflects that he entered active duty on 30 June 1968, when in fact he entered active duty on 27 September 1967. He was issued a DD Form 214 covering his service from 27 September 1967 to 29 June 1968. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

At the time of his enlistment he signed a statement in which he acknowledged that he understood that he would be required to enter active duty for training (ACDUTRA) within 120 days from that date unless as a high school student he was granted a longer delay and that if he entered ACDUTRA prior to becoming 18½...
