		IN THE CASE OF:

		BOARD DATE: 16 December 2010

		DOCKET NUMBER: AR20100013515

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of item 11 (Primary Specialty) of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show she served as a Financial Management Analyst (military occupational specialty (MOS) 36B) for a period of 9 years and 4 months.

2. She states her Enlisted Record Brief (ERB) shows the correct duration of time she served in her MOS. She attests that the individual who processed her DD Form 214 admits to making a mistake when reviewing her ERB.

3. She provides a copy of her ERB.

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in the Regular Army on 8 July 1999. Upon completion of basic and advanced individual training she was awarded MOS 73D (later converted to MOS 36B).

2. Her ERB shows she reported to her first permanent duty station on 6 December 2000.

3. On 20 April 2010, she was honorably discharged after completing 10 years, 9 months, and 13 days of active duty service.

4. The evidence shows 36B as the only MOS she was awarded. The evidence also shows she served in finance positions throughout her active duty tenure from 6 December 2000 through 20 April 2010, a period of 9 years, 4 months, and 15 days.

5. Item 11 of her DD Form 214 shows she served in MOS 36B for a period of 8 years and 4 months.

6. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. This regulation establishes standardized policy for the preparation of the DD Form 214. In pertinent part, it states that using data from the ERB, enter the titles of all MOS's served for at least 1 year and include for each MOS the number of years and months served. For time determination, 16 days or more count as a month. Do not count basic and advanced individual training.

DISCUSSION AND CONCLUSIONS:

1. The applicant's contention that her DD Form 214 should be corrected to show the proper amount of time she served in MOS 36B was carefully considered and determined to have merit.

2. The evidence clearly shows she served in MOS 36B from 6 December 2000 through 20 April 2010, a creditable period of 9 years and 4 months. However, item 11 of her DD Form 214 only credits her with 8 years and 4 months.

3. In view of the foregoing, she is entitled to correction of her DD Form 214 to show she served in MOS 36B for a creditable period of 9 years and 4 months.

BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the current entry in item 11 of her DD Form 214 and replacing it with the entry "36B3O FINANCIAL MANAGEMENT – 9 YRS 4 MOS//NOTHING FOLLOWS."

The evidence of record also shows that the applicant entered active duty in MOS 75H as a USAR (reserve component) Soldier and member of the AGR Program. The evidence of record shows that the applicant was discharged from active duty on 19 May 2004. Therefore, the applicant's records should be corrected to show that at the time of her discharge, she held MOS 75H2O (Personnel Services Specialist) as her primary specialty for 3 years and 5 months.

His record does not specify the date he was awarded MOS 55R; however, his Enlisted Record Brief (ERB) shows, on 13 June 1989, he was assigned to a unit in duty MOS (DMOS) 55R. The evidence of record does not support the applicant's request for correction of the period of service shown in item 11 of his DD Form 214. Therefore, item 11 of his DD Form 214 correctly shows he held MOS 89B for 21 years and 8 months.
