THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, correction of the military
occupational specialty (MOS) code and title that is entered on her
discharge document.
2. The applicant states, in effect, that she was awarded MOS 75H
(Personnel Services Specialist), not MOS 42A (Human Resources Specialist).
She also states, in effect, that it was probably an honest mistake that the
incorrect MOS was recorded on her discharge document and adds that she did
not notice the error until she started to apply for jobs.
3. The applicant provides copies of two DD Forms 214 (Certificate of
Release or Discharge from Active Duty), with effective dates of 7 December
2000 and
19 May 2004.
CONSIDERATION OF EVIDENCE:
1. The applicant’s military service records show that she enlisted in the
U.S. Army Reserve (USAR) for a period of 8 years on 2 August 2000. On 16
August 2000, the applicant was ordered to active duty, she completed Basic
Combat Training and Advanced Individual Training, and was awarded MOS 75H
(Personnel Services Specialist). The applicant was released from active
duty on
7 December 2000 after completing a total of 3 months and 22 days of net
active service.
2. The applicant’s military service records show that she was selected for
the USAR Control Group, Active Guard Reserve (AGR) Program. On 5 January
2003, she was ordered to active duty for a period of 3 years, in MOS 75H1O,
in the rank of specialist/pay grade E-4. The applicant was promoted to the
rank of sergeant/pay grade E-5, in MOS 75H2O, effective 14 February 2003.
She was honorably discharged on 19 May 2004, after completing 1 year, 8
months, and
28 days of total active service and placed on the Temporary Disability
Retired List, effective 20 May 2004.
3. The applicant's military service records contain a DA Form 2-1
(Personnel Qualification Record). Item 6 (Classification and Assignment
Data) of this document shows, in pertinent part, that the applicant was
awarded MOS 75H1O (Personnel Records Specialist) as her primary MOS,
effective 7 December 2000.
4. The applicant's military service records contain a DD Form 214, with an
effective date of 7 December 2000. Item 11 (Primary Specialty) contains
the entry "75H10 00 PERSONNEL SERVICE SP - - 0 YRS - 0 MOS//NOTHING
FOLLOWS."
5. The applicant's military service records contain a DD Form 214, with an
effective date of 19 May 2004. Item 11 (Primary Specialty) contains the
entry "42A20 HUMAN RESOURCES SPECIALIST - - 3 YRS - 9 MOS//NOTHING
FOLLOWS."
6. Headquarters, U.S. Total Army Personnel Command, Alexandria, Virginia,
memorandum, dated 31 October 2002, subject: Notification of Future Change
(NOFC) to DA Pam 611-21, E-0304-38, ADS XXI Realignment of Career
Management Field (CMF) 42 (Adjutant General), provided advance notification
of approved changes to the Military Occupational Classification and
Structure for implementation. This document, in pertinent part, deleted
MOS 75H, established MOS 42A, and also transferred the duties, functions,
positions, and personnel from MOS 75H to MOS 42A. This document also
shows, in pertinent part, that the personnel reclassification of affected
active component Soldiers was to be accomplished from 1 June 2003 to 30
September 2003, with an effective date of 30 September 2003. This document
further shows, in pertinent part, that the personnel reclassification of
affected reserve component Soldiers was to be accomplished from 1 May 2005
to 31 August 2005, with an effective date of
31 August 2005.
7. Army Regulation 635-5 (Separation Documents) prescribes the separation
documents that must be prepared for Soldiers on retirement, discharge,
release from active duty service, or control of the Active Army. It also
establishes standardized policy for preparing and distributing the DD Form
214. Chapter 2 contains guidance on the preparation of the DD Form 214.
It states, in pertinent part, that the source documents for entering
information on the DD Form 214 will be the Personnel Qualification Record
(PQR), Enlisted/Officer Record Brief (ERB/ORB), or any other document
authorized for filing in the Official Military Personnel File (OMPF).
8. Table 2-1 of the separation documents regulation, in effect at the time
of the applicant's discharge, contains item-by-item instructions for
completing the
DD Form 214. The instructions for Item 11 (Primary Specialty) specify to
enter the primary MOS or AOC (Area of Concentration), and all additional
MOS/AOC service for a period of one year or more, during the Soldier's
continuous active military service. For each MOS/AOC, list the title with
the years and months served. In determining time eligibility for listing
of specialty, it states that 16 days or more count as a month; however, do
not count Basic Combat Training and Advanced Individual Training.
DISCUSSION AND CONCLUSIONS:
1. The applicant contends, in effect, that the MOS code and title on her
DD Form 214 should be corrected because it is incorrect.
2. The evidence of record shows that the applicant was awarded MOS 75H
(Personnel Services Specialist) on 7 December 2000. The evidence of record
also shows that the applicant entered active duty in MOS 75H as a USAR
(reserve component) Soldier and member of the AGR Program. The evidence of
record further shows the applicant continued to serve on active duty in the
USAR Control Group, AGR Program, until she was discharged on 19 May 2004.
3. The evidence of record shows that for affected active component
Soldiers, personnel reclassification from MOS 75H to MOS 42A was effective
30 September 2003. The evidence of record also shows that for affected
reserve component Soldiers, personnel reclassification from MOS 75H to MOS
42A was effective 31 August 2005. Notwithstanding the fact that the
applicant was serving on active duty, based on the applicant's reserve
component status, her personnel reclassification was not scheduled to occur
until 2005. The evidence of record shows that the applicant was discharged
from active duty on 19 May 2004. Therefore, the applicant's records should
be corrected to show that at the time of her discharge, she held MOS 75H2O
(Personnel Services Specialist) as her primary specialty for 3 years and 5
months.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
showing the following correction to the applicant's DD Form 214, with an
effective date of 19 May 2004:

His AARTS transcript shows he held primary MOS 88M2O from February 2005 to present [6 November 2006, his separation date] for a total of 1 year and 8 months. Therefore, item 11 of his DD Form 214 should be corrected to show he served in MOS 42A2O for 3 years and 2 months and in MOS 88M2O for 1 year and 8 months.
