THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, award of the second Good Conduct Medal.   

2.  The applicant states, in effect, that he completed 3 years of active service and should have been awarded a second award of the Good Conduct Medal. 

3.  The applicant provides a copy of his DD Form 214 (Certificate of Release or Discharge from Active Duty), dated 25 March 2007; a copy of Permanent Orders 046-0024, issued by Headquarters, U.S. Army Armor Center, Fort Knox, KY, on 15 February 2005; and an undated certificate, showing award of the Good Conduct Medal (1st Award), in support of his request. 

CONSIDERATION OF EVIDENCE:

1.  The applicant's records show he enlisted in the Regular Army for a period of 6 years on 26 March 2001.  He completed basic combat and advanced individual training and was awarded military occupational specialty (MOS) 11B (Infantryman).  He was honorably separated in the rank/grade of staff sergeant (SSG)/E-6 and transferred to the U.S. Army Reserve Control Group (Reinforcement) on 25 March 2007.  

2.  The applicant’s records show he served in Iraq from 28 March 2003 to 27 March 2004. 


3.  Item 24 (Decoration, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 shows he was awarded the Army Commendation Medal, the Good Conduct Medal, the National Defense Service Medal, the Global War on Terrorism Service and Expeditionary Medals, the Noncommissioned Officer Professional Development Ribbon, the Army Service Ribbon, the Overseas Service Ribbon, the Combat and Expert Infantryman Badges, the Driver and Mechanic Badge with Driver (Wheeled) Clasp, the Basic Recruiter Badge (Gold), and the Basic Recruiter Badge (Silver with three gold achievement stars).  Item 24 does not show a second award of the Good Conduct Medal.

4.  Headquarters, U.S. Army Armor Center, Fort Knox, KY, Permanent 
Orders 046-0024, dated 15 February 2005, show the applicant was awarded the Good Conduct Medal (1st Award) from 26 March 2001 to 25 March 2004. 

5.  The applicant’s records do not contain orders for a second award of the Good Conduct Medal for the period 26 March 2004 to 25 March 2007.  

6.  A review of the applicant's service record shows no derogatory information that would disqualify him for a second award of the Good Conduct Medal. Furthermore, the applicant’s evaluation reports show he received either successful or superior ratings during the period March 2004 to March 2007. 

7.  Army Regulation 600-8-22 (Military Awards) provides that the Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service.  This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service.  Although there is no automatic entitlement to the Good Conduct Medal, disqualification must be justified.  

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that he is entitled to a second award of the Good Conduct Medal.

2.  The evidence of record confirms the applicant served honorably during the period 26 March 2004 through 25 March 2007.  He attained the rank of SSG/E-6, returned from a combat tour in Iraq, and evaluation report ratings were successful or above.  He also performed successfully as a recruiter during this period.  Lacking any derogatory information on file that would have disqualified him, it would be appropriate to award the applicant the second award of the Good Conduct Medal based on completion of qualifying service from 26 March 2004 through 25 March 2007 and correct his records to show this award.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  awarding the applicant the Good Conduct Medal (2nd Award) for exemplary behavior, efficiency, and fidelity during the period 26 March 2004 through 25 March 2007; and

	b.  deleting the entry “Good Conduct Medal (1st Award) from his DD Form 214, dated 25 March 2007, and adding the Good Conduct Medal (2nd Award).
