THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests the removal of a civilian education transcript dated 11 October 2005 from her official military personnel file (OMPF).
2. The applicant states that the transcript in question is an old transcript and she has since added one from the same college showing her degree awarded. She further states that she requested to have the transcript removed from her OMPF but was informed that she must apply to the Board.
3. The applicant provides no additional information with her application.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the United States Army Reserve on 11 December 1996 for a period of 8 years under the delayed entry program. She enlisted in the Regular Army on 23 January 2007 for a period of 4 years and training as a Morse interceptor.
2. She completed her basic training at Fort Leonard Wood, Missouri, and her advanced individual training at Fort Huachuca, Arizona. She has remained on active duty through a series of continuous reenlistments and was promoted to the pay grade of E-7 on 1 September 2006.
3. A review of her OMPF shows that she has three transcripts filed in her OMPF. The transcript in question dated 11 October 2005 was issued by American Military University and reflects a total of 36 hours earned. Another transcript from the same institution dated 8 June 2007 reflects a total of 60 hours and a third transcript from Cochise College dated 15 February 2008 reflects 86 hours.
4. Army Regulation 600-8-104 (Military Personnel Information Management/
Records) serves as the authority for filing of documents in the OMPF. It provides, in pertinent part, that all transcripts of credit from civilian colleges, universities, trade schools, or business schools will be filed in the OMPF for enlisted personnel. For Judge Advocate General and Army Medical Department officer, file only transcripts showing completion of degree or completion of program.
DISCUSSION AND CONCLUSIONS:
1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
2. The transcript in question is properly filed in the applicant's OMPF in accordance with the applicable regulations and she has failed to show through evidence submitted with her application and the evidence of record sufficient basis to remove it.
3. The applicant's contention has been noted; however, the government has an interest in maintaining such records and the applicant has not shown sufficient basis as to why the transcript should not remain a matter of record. Furthermore, in its current filing configuration, it reflects that the applicant has made steady progress in pursuing her civilian education.
4. Therefore, absent evidence to show that it is not properly filed in her OMPF, there appears to be no basis to remove it from her OMPF.
