THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests Permanent Order 338-113, Department of the Army (DA), Detachment C, 55th Personnel Services Battalion, dated 4 December 1998, be removed from his Official Military Personnel File (OMPF).
2. The applicant states the permanent order in question is erroneous and should be removed from his OMPF. He states the erroneous order was based on his date of enlistment in the Delayed Entry Program (DEP) and not on his actual date of entry into active duty, which was 2 December 1992. He further states that a second order [Permanent Order 327-107, same headquarters, for the period 2 December 1995 to 1 December 1998], dated 23 November 1998 in his record is the one that should be retained in his OMPF.
3. The applicant provides a copy of Permanent Order 338-113, Department of the Army Detachment C, 55th Personnel Services Battalion, dated 4 December 1998.
CONSIDERATION OF EVIDENCE:
1. The applicant is a sergeant first class (SFC)/E-7 in the Regular Army.
2. A review of the applicant's OMPF maintained on the Interactive Personnel Electronic Records Management System (iPERMS) shows both Permanent Order 338-113 and Permanent Order 327-107 awarded the applicant the AGCM
(Second Award) covering virtually the same period of service.
3. Army Regulation 600-8-104 (Military Personnel Information Management/ Records) prescribes the policies and mandated operating tasks for the Military Personnel (MILPER) Information Management/Records Program of the Military Personnel System. It establishes principles of support, standards of service, policies, tasks, rules, and steps governing all work required in the field to support MILPER Information Management/Records. It states, in pertinent part, that once placed in the OMPF, a document becomes a permanent part of that file. The document will not be removed from a fiche or moved to another part of the fiche unless directed by competent authority.
DISCUSSION AND CONCLUSIONS:
1. The applicant requests the removal of Permanent Order 338-113, dated
4 December 1998, awarding him the AGCM (Second Award) from his OMPF.
2. A review of iPERMS shows that both of the abovementioned orders are filed in the applicantÂ’s OMPF. It appears that Permanent Order 338-1136, dated
4 December 1998, contains the erroneous period of service for award of the AGCM (Second Award) and should be removed from his OMPF.
3. Given the above, Permanent Order 338-1136, dated 4 December 1998 should be removed from the applicantÂ’s OMPF.
