The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, promotion consideration for chief
warrant officer three by a special selection board (SSB) (Promotions
Advisory Board) under the 2006, year criteria, and if necessary, the 2007
year criteria.
2. The applicant states, in effect, that he was not considered for
promotion to chief warrant officer three by the 2006 or the 2007 promotion
selection board because he was erroneously omitted from consideration.
3. The applicant provides no additional documentation in support of his
request.
CONSIDERATION OF EVIDENCE:
1. Based on a review of the applicant’s records by the Office of
Promotions, Reserve Components, Human Resources Command, St. Louis, the
applicant has a basis for a warrant officer SSB for consideration under the
2006 year criteria due to omission from consideration by that board. He
also has a basis for an SSB under the 2007 year criteria, if necessary.
2. Current promotion policy specifies that promotion
consideration/reconsideration by a SSB may only be based on erroneous non-
consideration or material error that existed in the record at the time of
consideration.
DISCUSSION AND CONCLUSIONS:
1. The applicant’s records were not considered for promotion to chief
warrant officer three under the 2006 and the 2007 year criteria, and should
now be submitted for appropriate SSB consideration for this purpose.
2. In view of the foregoing findings and conclusions, it would be
appropriate to correct the applicant’s records as recommended below.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to
warrant a recommendation for relief. As a result, the Board recommends
that all Department of the Army records of the individual concerned be
corrected by submitting his records to a duly constituted special
selection board for promotion consideration for chief warrant officer
three under the 2006 year criteria, and under the 2007 year criteria, if
necessary.
2. That if selected, his records be further corrected by showing he was
promoted to chief warrant officer three on his date of eligibility, as
determined by appropriate Departmental officials, using the appropriate
criteria, provided he was otherwise qualified and met all other
prerequisites for promotion.
3. That if not selected, the applicant be so notified.
