      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, promotion consideration for chief
warrant officer three (CW3) by special selection boards (SSB).

2.  The applicant states, in effect, that he should have received promotion
consideration to CW3.  He also states that according to a number of
personnel advisors, he should have a pending promotion to CW3, which should
have occurred in April 2006.

3.  The applicant states he has provided a copy of his warrant officer one
appointment orders in support of his request; however, this document was
not provided to the Board with his application.

CONSIDERATION OF EVIDENCE:

1.  Based upon a review of the applicant’s records by the Office of
Promotions, Reserve Components, Human Resources Command – St. Louis,
Missouri, it was determined the applicant was erroneously not considered by
the 1999 through 2006 Reserve Components Selection Boards and was eligible
for consideration for promotion to CW3, under criteria for promotion boards
that convened from 1999 through 2006, as an omission.

2.  Current promotion policy specifies that promotion consideration or
reconsideration by a SSB may only be based on erroneous non-
consideration or material error that existed in the record at the time
of consideration.

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s records were erroneously not considered for promotion
to CW3 under criteria established for promotion boards which convened from
1999 through 2006 and should now be submitted for appropriate SSB
consideration for this purpose.

2.  In view of the foregoing findings and conclusions, it would be
appropriate to correct the applicant’s records as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to
warrant a recommendation for relief.  As a result, the Board recommends
that all Department of the Army records of the individual concerned be
corrected by submitting his records to duly constituted special selection
boards for promotion consideration for chief warrant officer three under
criteria for selection boards which convened from 1999 through 2006.

2.  If selected for promotion, the applicant’s records should be
corrected by showing he was promoted to chief warrant officer three on
his date of eligibility, as determined by appropriate Departmental
officials, using the appropriate year's criteria (1999 through 2006)
under which he was selected, provided he was otherwise qualified and met
all other prerequisites for promotion.

3.  If not selected, the applicant should be so notified.
