APPLICANT REQUESTS: That his DD Form 214 (Report of Separation from Active Duty) be amended to show his correct social security account number (SSAN).
APPLICANT STATES: That the SSAN on his DD Form 214 is incorrect. He was notified by the Social Security Administration that his SSAN was changed to 4__-0_-6___.
COUNSEL CONTENDS: Counsel makes no additional contention.
EVIDENCE OF RECORD: The applicant's military records show:
He enlisted in the Regular Army on 26 July 1976 under the SSAN 4__-2_-5___. All documents in his records show his SSAN as 4__-2_-5___. His DD Form 214 shows that he was honorably released from active duty on 29 July 1979 under SSAN 4__-2_-5___
The applicant provides a copy of a social security card which shows his SSAN as 4__-0_-6___.
Army Regulation 635-5 prescribes the separation documents prepared for soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. In pertinent part it states that the DD Form 214 is a synopsis of the soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. For historical purposes, the Army has an interest in maintaining the accuracy of its records. The data and information contained in those records should actually reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, this Board is reluctant to recommend that those records be changed.
2. The applicant provides a copy of a social security card which shows his SSAN as 4__-0_-6___. No letter from the Social Security Administration is provided to explain whether that SSAN was newly-issued to him or if SSAN 4__-2_-5___ had always been in error. Nevertheless, he appropriately served on and was released from active duty under SSAN 4__-2_-5___.
3. While the Board understands the applicant’s desire to have the records changed, it finds no basis for compromising the integrity of the Army’s records. This Board action will be filed in his military records so a record of his SSAN of 4__-0_-6___ will be on hand.
4. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
