APPLICANT REQUESTS: That his Certificate of Release or Discharge from Active Duty, DD Form 214, be amended to show his correct social security number (SSN).
APPLICANT STATES: That the problem with his SSN is causing problems with his Veterans Affairs (VA) disability. The VA has corrected his SSN. He provides a copy of his social security card signed by his county VA officer and his DD Form 214 as supporting evidence.
EVIDENCE OF RECORD: The applicant's military records show:
He enlisted in the Delayed Entry Program on 4 October 1982. His Enlistment/Reenlistment Document – Armed Forces of the United States, DD Form 4/1, shows his SSN as ___-_8-9283. His Record of Military Processing – Armed Forces of the United States, DD Form 1966/6, is annotated that the applicant had stated his little nephew was the individual that made all of the marks on his social security account number (SSAN) card. His DD Form 1966/7, item 40e indicated that the recruiter verified his SSN using his (SSAN) card. All documents in the applicant’s military personnel records, to include the National Agency Check Request, DD Form 1584, and a Criminal Investigation Report of Investigation show his SSN as ___-_8-9283. He was discharged on 18 December 1984. His DD Form 214 shows his SSN as ___-_8-9283.
The applicant provides a copy of an SSAN card showing his SSN as ___-_6-1826. The Lowndes County (Mississippi) Veteran’s Affairs Officer has annotated this document with the notation “This is a copy Mr ___’s original Social Security Card.”
Army Regulation 635-5 prescribes the separation documents prepared for soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. In pertinent part it states that the DD Form 214 is a synopsis of the soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. For historical purposes, the Army has an interest in maintaining the accuracy of its records. The data and information contained in those records should actually reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, this Board is reluctant to recommend that those records be changed.
2. When the applicant enlisted, his SSN was shown as ___-_8-9283 on his enlistment documents and his recruiter indicated that he had verified the applicant’s SSN from his SSAN card. He served on and was separated with his SSN as ___-_8-9283. He does not explain why, if the copy of the SSAN card he provided with this application was made from his original card, he enlisted under a different SSAN.
3. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
