APPLICANT REQUESTS: In effect, that his military records be corrected to reflect his correct Social Security Account Number (SSAN).
APPLICANT STATES: In effect, that the SSAN reflected in his military records is incorrect. He contends that after he entered the Army in 1979, the Social Security office informed him that the SSAN shown in his military records was never issued to anyone and he was given another SSAN. In support of his application, he submits an undated letter of explanation; a letter from the Social Security Administration, dated 14 November 2000; an information paper titled “Verification of Your Social Security Number”; and a copy of a Social Security card and Missouri Driver License.
EVIDENCE OF RECORD: The applicant's military records show:
The applicant entered active duty on 4 May 1979 and served as a cannon crewman. He was honorably released on 1 May 1982 under the provisions of Army Regulation 635-200 due to short length of time remaining on active duty which precluded reassignment.
The applicant’s DD Form 4/1 (Enlistment/Reenlistment Document - Armed Forces of the United States), dated 2 May 1979; his DA Form 2-1 (Personnel Qualification Record) prepared on 7 May 1979; and his DD Form 214 (Certificate of Release or Discharge from Active Duty), authenticated in his own hand on
1 May 1982; display the same SSAN.
The applicant provided a copy of a Social Security card which displays a different SSAN from that contained in his military records.
Army Regulation 635-5 establishes the standardized policy for preparing and distributing the DD Form 214. In pertinent part, it directs the SSAN will be entered in item number 3 of the DD Form 214. The regulation also directs the SSAN will be verified for accuracy from the soldier’s DA Form 2 and 2-1 (Personnel Qualification Records), which is formerly known as the DA Form 20.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. The Board considered the applicant’s contentions pertaining to his correct SSAN and the Social Security card provided in support of his claim. However, evidence of record shows the SSAN reflected in the applicant’s military records is the same SSAN used at the time of his enlistment in 1979 and discharge from the Army in 1982.
2. The Board noted the applicant’s contention that the Social Security Administration told him the SSAN used during his Army service was never issued to anyone. However, the applicant has provided no evidence to support this assertion. In view of the foregoing, there is no evidence that the SSAN used by the applicant during his Army service was incorrect. Therefore, there is no basis for changing the applicant’s SSAN in his military records.
3. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
4. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
