RECORD OF PROCEEDINGS
IN THE CASE OF:
BOARD DATE: 25 MARCH 2004
DOCKET NUMBER: AR2003094498
I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.
| |Mr. Carl W. S. Chun | |Director |
| |Ms. Deborah L. Brantley | |Senior Analyst |
The following members, a quorum, were present:
| |Mr. Luther L. Santiful | |Chairperson |
| |Mr. Lester Echols | |Member |
| |Mr. Thomas E. O'Shaughnessy, Jr. | |Member |
The applicant and counsel if any, did not appear before the Board.
The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that her May 2003 separation document be
corrected to show that she entered active duty on 21 January 2003 vice 23
June 1999 and that her active duty service computation be corrected
accordingly.
2. The applicant states, in effect, that she entered active duty as part
of a unit activation in support of Operation Enduring Freedom on 21 January
2003 and was discharged on 18 May 2003.
3. The applicant provides a copy of her separation document in addition to
her unit activation and discharge orders.
CONSIDERATION OF EVIDENCE:
1. Records available to the Board indicate that the applicant enlisted in
the United States Army Reserve on 8 January 1999 and graduated from high
school in June 1999. She was ordered to active duty for the purpose of
undergoing training on 23 June 1999. She was released from active duty and
returned to her United States Army Reserve (211th Transportation Company)
unit on
11 November 1999.
2. On 15 January 2003 orders were issued ordering the applicant’s United
States Army Reserve (211th Transportation Company) unit to active duty,
effective 21 January 2003, in support of Operation Enduring Freedom. On
18 May 2003 the applicant was released from active duty. Her active duty
during this period would have amounted to 3 months and 28 days.
3. The applicant’s May 2003 separation document, however, incorrectly
reflects the date the applicant initially entered active duty, 23 June
1999, in item 12a (Date entered AD This Period) rather than the 21 January
2003 date the applicant actually entered active duty. Because the entry in
item 12a is incorrect, the entry in item 12c (Net Active Service This
Period) is also incorrect. The applicant’s 4 months and 19 days of prior
active service, between June and November 1999 is accurately recorded in
item 12d (Total Prior Active Service) of her May 2003 separation document.
DISCUSSION AND CONCLUSIONS:
The evidence confirms that the applicant did enter active duty on 21
January 2003 and served a period of 3 months and 28 days prior to being
released from active duty on 18 May 2003. It is possible that the
individual preparing the applicant’s May 2003 separation document
incorrectly transposed the date the applicant entered active duty from her
original separation document. Because the entry date was incorrect the
entry in item 12c would also have been calculated incorrectly.
BOARD VOTE:
__LLS___ __LE ___ ___TEO _ GRANT RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
a. showing in item 12a on her May 2003 separation document that she
entered active duty on 21 January 2003; and
b. showing in item 12c that her net active service was 3 months and
28 days.
