THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 15 January 2009 to show: a. in item 12a (Date Entered Active Duty This Period) the entry "20030225"; b. in item 12c (Net Active Service This Period) the entry "051021"; and c. in item 12d (Total Prior Active Service) "100407." 2. The applicant states she was issued a DD Form 214 for the period 25 February 2003 through 21 September 2005 which was revoked due to an extension of her continuous active service until 15 January 2009. 3. The applicant provides her DD Form 214 to be corrected; a revoked DD Form 214; the memorandum revoking that DD Form 214; Headquarters, 108th Division (Institutional Training (IT)) Orders M-056-0020; Headquarters, U.S. Army Training Center (USATC) and Fort Jackson Orders 76-91; Headquarters, 108th Division (IT) Orders 04-014-00006; Headquarters, USATC and Fort Jackson Orders 37-99; U.S. Army Human Resources Command (HRC) Orders A-02-503072; Headquarters, USATC and Fort Jackson Orders 34-93; HRC Orders A-08-517578; HRC Orders A-08-517578A01; HRC Orders A-08-517578A02; HRC Orders A-08-517578A03; and HRC Orders A-08-517578A04. CONSIDERATION OF EVIDENCE: 1. The applicant entered active duty from a U.S. Army Reserve unit on 25 February 2003 in support of Operation Iraqi Freedom. She was released from active duty on 15 January 2009 and returned to her U.S. Army Reserve unit after completing 5 years, 10 months, and 21 days of continuous active duty service. 2. Her record in iPERMS contains three DD Forms 214 and a DD Form 215 covering prior U.S. Marine Corps active duty. The combined total active service from these forms is 10 years, 4 months, and 7 days. 3. Headquarters, 108th Division (IT) Orders M-056-0020, dated 25 February 2003, show she was ordered to active duty in support of Operation Enduring Freedom for a period of 365 days. These orders were amended to cover a period of 731 days. 4. HRC Orders A-08-517578, dated 22 August 2005, ordered her to active duty for the period 23 August 2005 to 22 August 2006. These orders were amended to show an ending date of 21 September 2006. 5. Her DD Form 214 for the period 25 February 2003 through 21 September 2005 shows she was ordered to active duty in support of Operation Enduring Freedom in accordance with (IAW) 10 U.S. Code 12301. Item 12d of this form shows 10 years, 4 months, and 7 days of prior active service. Item 18 (Remarks) also shows "Other name(s) of record: Grifxxx, Erica Caxx." 6. Her DD Form 214 for the period 22 September 2005 through 15 January 2009 shows in the remarks section that she was ordered to active duty in support of Operation Enduring Freedom IAW 10 U.S. Code 12301. This form further shows: * in item 12a the entry "2005 09 22" * in item 12c the entry "0003 03 24" * in item 12d the entry "0012 11 04" 7. The Chief, Personnel Operations Work Center, Fort Jackson, SC, in a memorandum dated 24 December 2008, subject: Request to Void and Remove Original DD Form 214 from IPERMS, that the applicant's DD Form 214 for the period ending 21 September 2005 currently in her file be removed. The justification for removal was that the applicant received extension orders and would be issued a new DD Form 214 at the end of the mobilization. 8. An Army Reserve Personnel Center (ARPC) Form 249-E (Chronological Statement of Retirement Points) shows she served continuously on active duty from March 2003 to January 2009. 9. Army Regulation 635-5 prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. The DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active service at the time of release from active duty, retirement or discharge. DISCUSSION AND CONCLUSIONS: 1. Evidence shows the applicant was ordered to active duty on 25 February 2003 in support of Operation Enduring Freedom. Her records show through orders, amendments to those orders, a memorandum requesting the voiding and removal of an erroneous DD Form 214, an erroneous/voided DD Form 214, and ARPC Form 249-E that she served continuously on active duty during the period 25 February 2003 through 15 January 2009. As such, she is entitled to correction of her DD Form 214 for the period ending 15 January 2009 to show: a. in item 12a the entry "2003 02 25"; b. in item 12c the entry "0005 10 21" 2009-01-15 ending date of the continuous period of service 2003-02-25 beginning date of continuous period of service 5-10-20 + 1 provides for inclusive dates 5-10-21 net active service this period; and c. in item 12d the entry "0010 04 07." 2. As a result of the above corrections to show her continuous active service for the period 25 February 2003 through 15 January 2009 on her corrected DD Form 214, her DD Form 214 for the period 25 February 2003 through 21 September 2005 should be voided if not already accomplished. 3. In view of the foregoing, her DD Form 214 in question should be corrected as shown below.
