         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his enlistment contract be corrected to show he enlisted for 8 years and 00 weeks.

3. The applicant states, in effect, that his enlistment contract erroneously shows he enlisted for 6 years and 00 weeks.

4. The applicant enlisted in the U. S. Army Reserve on 9 February 2001. His Enlistment/Reenlistment Document Armed Forces of the United States, DD Form 4/1, item 8 erroneously shows he enlisted for 6 years and 00 weeks. Effective 1 June 1984, all personnel incur an 8-year statutory obligation on initial entry into the Armed Forces.

CONCLUSIONS
:

1. There is an administrative error on the applicant’s DD Form 4/1. By law, he incurred an 8-year obligation upon enlisting in the U. S. Army Reserve on 9 February 2001 and so item 8 should have reflected that he enlisted for 8, not 6, years and 00 weeks.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s DD Form 4/1 dated 9 February 2001, item 8 be corrected to show he enlisted for 8 years and 00 weeks.
