         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his enlistment contract be corrected to show he enlisted for a term of 8 years and 00 weeks.

3. The applicant states that his enlistment contract erroneously shows he enlisted for 6 years and 00 weeks.

4. The applicant’s military records show that he enlisted in the U.S. Army Reserves on 24 September 2001, in the pay grade of E-4, with no prior service.
His Enlistment/Reenlistment Contract, DD Form 4/1, item 8 shows he enlisted for a term of 6 years and 00 weeks.

5. On 15 September 2000, prior to the applicant’s enlistment he earned a Bachelor of Arts degree from the University of California.

6. Army Regulation 601-210, states in pertinent part, that non-prior service applicant’s enlisting in the Regular Army or the U.S. Army Reserve incur an
8 years statutory military service obligation.

CONCLUSIONS:

1. There is an administrative error on the applicant’s DD Form 4/1. The evidence of record shows he enlisted on 24 September 2001 for period of
8 years and 00 weeks, and not 6 years and 00 weeks.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s DD Form 4/1, item 8, be corrected to show he enlisted on 24 September 2001 for 8 years and 00 weeks.
