         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his enlistment contract be corrected to show he enlisted for 4 years and 00 weeks.

3. The applicant states, in effect, that his enlistment contract erroneously shows he enlisted for 8 years and 00 weeks.

4. The applicant’s military records show that he had prior active duty from 11 September 1979 until 12 June 1986, when he was discharged under the provisions of Army Regulation 635-200, chapter 14.

5. His U. S. Army Recruiting Command reservation sheets and Record of Military Processing - Armed Forces of the United States, DD Form 1966/3, show that he enlisted in the U. S. Army Reserve on 19 February 2002 for 4 years and 00 weeks (or 48 months). His Enlistment/Reenlistment Contract, DD Form 4/1, item 8 erroneously shows he enlisted for 8 years and 00 weeks.

CONCLUSIONS:

1. There is an administrative error on the applicant’s DD Form 4/1. The evidence of record shows he enlisted in the U. S. Army Reserve on 19 February 2002 for 4 years and 00 weeks, not 8 years and 00 weeks.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s DD Form 4/1 dated 19 February 2002, item 8 be corrected to show he enlisted for 4 years and 00 weeks.
