PROCEEDINGS

         IN THE CASE OF:

         BOARD DATE: 2 October 2001
         DOCKET NUMBER: AR2001061986

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Mrs. Nancy Amos Analyst

The following members, a quorum, were present:

Ms. Margaret K. Patterson Chairperson
Ms. Karol A. Kennedy Member
Mr. Richard T. Dunbar Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests that her enlistment contract be corrected to show she enlisted for 8 years and 00 weeks.

3. The applicant states, in effect, that her enlistment contract erroneously shows she enlisted in the U. S. Army Reserve (USAR) for 6 years and 00 weeks.

4. The applicant’s Enlistment/Reenlistment Contract, DD Form 4/1, item 8 erroneously shows she enlisted in the USAR on 13 July 2001 for 6 years and 00 weeks. Effective 1 June 1984, all personnel incur an 8-year statutory obligation on initial entry into the Armed Forces.

CONCLUSIONS:

1. There is an administrative error on the applicant’s DD Form 4/1. By statute, she should have enlisted in the USAR on 13 July 2001 for 8 years and 00 weeks, not 6 years and 00 weeks.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s DD Form 4/1 dated 31 July 2001, item 8 be corrected to show she enlisted in the USAR for 8 years and 00 weeks.
