         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show that he completed the Heavy Wheel Vehicle Mechanic Course and was awarded military occupational specialty (MOS) 63S, Heavy Wheel Vehicle Mechanic.

3. The applicant states, in effect, that he completed both basic combat training (BCT) and advanced individual training (AIT) in MOS 63S. He needs his DD Form 214 corrected to show that he is MOS-qualified in order to enlist in the Louisiana Army National Guard (LAARNG). In support of his request, he submits: a copy of his DD Form 214; a copy of his certificate/diploma for completion of the Heavy Wheel Vehicle Mechanic Course at Fort Jackson, South Carolina; a copy of BCT and AIT training records; a Certificate of Affiliation with the United States Army Ordnance Corps; and a copy of Orders #219-1326, Headquarters, United States Army Training Center, Fort Jackson, South Carolina, dated 7 August 1998.

4. The applicant's official military personnel record was not available. The information herein was obtained directly from the applicant. It shows that, on 9 October 1998, the applicant was ordered to active duty for training from the LAARNG. On 7 July 1998, he completed the academic requirements for the Heavy Wheel Vehicle Mechanic Course. Even though he completed the academic requirements for the course, there are no orders available awarding him MOS 63S.

5. On 10 August 1998, the applicant was separated from active duty under the provisions of chapter 11, Army Regulation 635-200 for entry level status (ELS) performance and conduct with an honorable discharge. The specific circumstances surrounding the discharge are unknown. He had completed 6 months and 2 days of active military service.

6. Orders 219-1326 show that, on 10 August 1998, the applicant was released from active duty for training, discharged as a the Reserve of the Army, and returned to the LAARNG.

7. Army Regulation 635-5 prescribes the policies and procedures for preparing separation documents for soldiers upon retirement, discharge, or release from active military service. In pertinent part, it states that the MOS code will be entered in Item 11 of DD Form 214 when an individual has served in the MOS for at least 1 year after completion of MOS training. It also states that the title, duration, and month/year of in-service training courses successfully completed during the current period of service will be entered in Item 14 of the DD Form 214.


CONCLUSIONS:

1. In July 1998, the applicant successfully completed the academic requirements for the 10-week Heavy Wheel Vehicle Mechanic Course and is entitled to have the training indicated in Item 14 on his DD Form 214.

2. Although the applicant completed an in-service, MOS-producing course of instruction, he did not serve in the MOS for the requisite 1-year period. Therefore, according to regulation, he is not entitled to have the MOS listed in Item 11 of his DD Form 214.

3. In view of the foregoing, the applicant’s records should be corrected, but only as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by issuing a DD Form 215 (Correction to DD Form 214) to the individual concerned showing in Item 14 that he completed the "HEAVY WHEEL VEHICLE MECHANIC COURSE, 10 WEEKS, JUL98//NOTHING FOLLOWS."

2. That so much of the application as is in excess of the foregoing be denied.
