AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE		 CASE NUM BER

GENERAL: The applicant appeals for upgrade of discharge to Honorable and to change the reason and authority for the discharge.

The applicant was offered a personal appearance before the Discharge Review Board (ORB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING: The Board grants the requested relief. The Discharge is upgraded to Honorable.

The Board finds evidence in the record to substantiate an impropriety that would justify a change in the discharge. Therefore, for the reasons specified below, the Board grants the upgrade of the applicant's discharge, the change the narrative reason for discharge to Secretarial Authority.

ISSUE: The applicant received a General discharge for Miscond uct - Drug Abuse

The Air Force Discharge Review Board, under its responsibil i ty to examine the propriety and equity of an Applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. In reviewi ng discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The applicant's record of service included one Article 15 for wrongful use of oxycodone.

The applicant submitted no specific issues regardi ng the inequity or impropriety of his discharge. The applicant does submit that he was unaware that the pain med ications he received from a fellow Airman was illegal for him to take, he thought it was like taking some ibuprofen and that he did not take it in efforts to get high. A statement was submitted by the other Airman that the applicant complained of a headach e and asked for something to take, and he removed the pill form the bottle and gave it to him. The Board reviewed
the entire record and concluded there was sufficient mitigation and extenuation to substantiate upgrade of the discharge to Honorable and to change the reason and authority of the discharge.

CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.

However, in view of the foregoing findings, the Board concludes that the overall quality of applicant's service is more accurately reflected by an Honorable discharge and the reason for the discharge is more accurately described as under Secretarial Authority under the provisions of Title 10, USC 1553.
