GENERAL: The applicant appeals for a change to the reason and authority for the discharge and a change to the reenlistment code.

The applicant appeared and testified before the Discharge Review Board (DRB), without counsel, at Joint Base Andrews MD on December 11, 2014.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING: The Board grants the request to change the reason and authority for discharge, and the request to change the reenlistment code is denied. The Board finds evidence in the record to substantiate an impropriety that would justify a change in the narrative reason. Therefore, for the reasons specified below, the Board grants the change in the narrative reason for discharge to Secretarial Authority.

ISSUE: The Air Force Discharge Review Board, under its responsibility to examine the propriety and equity of an Applicant's discharge, is authorized to change the character of service and the reason for discharge if such change is warranted. In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board did complete a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety.

Applicant received an Honorable discharge for Personality Disorder. Applicant submitted no issues regarding the inequity or impropriety of his discharge. A review of the record indicated that a clinical psychologist diagnosed him with a personality disorder which was so severe his ability to function effectively in the military environment was significantly impaired. However, other evidence in the medical record supported a different diagnosis that may have warranted a medical evaluation board instead. The applicant testified that subsequent to discharge he received a medical diagnosis for a condition that does not support the personality disorder diagnosis. The Board found the applicant credible. Given the above, the board determined that his discharge for personality disorder was improper and premature. In light of the applicant's medical condition, the Board denies the change to the reenlistment code.

CONCLUSION: The Discharge Review Board concludes that the discharge was inconsistent with the procedural and substantive requirements of the discharge regulation and finds the applicant was not provided full administrative due process.

In view of the foregoing findings, the Board concludes that the reason for the discharge is more accurately described as Secretarial Authority under the provisions of Title 10, USC 1553. The Board denies the change to the reenlistment code. However, the applicant is entitled to apply to the Air Force Board for Correction of Military Records to request relief.
