GENERAL: The applicant appeals for upgrade of discharge to honorable.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. FINDING: The Board grants the requested relief.
ISSUE: Applicant received a general discharge for Pattern of Misconduct: Failure to Meet Financial Obligations.
Applicant contends discharge was inequitable because it was too harsh. Applicant states while serving in the Air Force Reserve at Seymour Johnson AFB, his state employer transferred him to a facility that was several hours away from his home. Due to the commute length, the applicant left his position, moved to Massachusetts and stayed with his wife's parents. While in Massachusetts looking for employment and residence, he was unable to fulfill his financial and Reserve responsibilities. He also states his time during both Active and Reserve duty up to this event were exemplary with zero conduct issues and does not feel this one event justifies his general discharge. The record indicates that the applicant was past due 185 days on his GTC.
A discharge is upgraded only if the applicant and the Board can establish that an inequity or impropriety took place at the time of discharge. When a member's misconduct occurred while he was in a civilian status, it is necessary to consider additional criteria before relying on that misconduct to characterize the respondent's military service. In order to be used for a General Service characterization, AFI 36-3209, paragraph A2.2.2, requires misconduct in a civilian status to have "an adverse impact on the effectiveness of the Air Force, including military morale and efficiency." In this case, there was no link between the applicant's misconduct and military effectiveness. After a thorough review of the record, the Board found evidence to justify an upgrade of the discharge characterization.
CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.
However, in view of the foregoing findings, the Board concludes that the overall quality of applicant's service is more accurately reflected by an Honorable discharge under the provisions on Title 10, USC 1553..
