GENERAL:  'I'he  applicant appeals for upgrade of discharge to Honorable. 

The applicant was offered a personal  appearance before the Discharge Review Hoard  (DRB) but declined to 
exercise this right. 

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. 

FINDINGS:  Upgrade of discharge is denied. 

The Board  finds the applicant submitted no  issues  contesting  the equity  or propriety  of the discharge, and 
after a thorough review of the record, the Board  was  unable to  identifi. any that  woi.11d justify  a change of 
discharge. 

ISSUE: 

The applicant submitted  no  specific  issues  but  stated  a desire to  have  his discharge  upgraded  for  a  second 
chance at getting his life back on track and back into the career that the AF trained him in.  IIe states that his 
AF  career  speaks  for  itself  with  numerous awards  and  decorations and  the  only fault or  flaw was the  one 
incident  that  cost him.  The record  indicates  that  the  applicant  received  an Article  15 for  wrongful  use  of 
marijuana  and  received  a  reduction  to  Senior  Airman.  The  Board  took  note  of  the  applicant's  duty 
letters  of  recommendatio~i and  other 
performance  as  documented  by  his  performance 
accomplishments,  but  found  the  seriousness  of  the  willful  misconduct  was  significant  departure  from 
conduct expected of all military members and offset any positive aspects of the applicant's duty performance. 
The Board concluded that the characterization of the discharge received by the applicant to be appropriate.

CONCLUSIONS:  The  Discharge  Review  Board  concludes  that  the  discharge  was  consistent  with  the 
procedural  and  substailtive  requirements  of  the  discharge regulation  and  was  within  the  discretion  of  the 
discharge authority and that the applicant was provided full administrative due process. 

In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis lor 
upgrade of discharge, thus the applicant's discharge should not be changed.

Issue I:  An upgrade or change is requested due to the last six months I 

have felt the effect of Letting down myself, my unit, and my country by not 
folowing my core valves given to me by the USAF.  I know my decision was 
dumbfounded and cureless (sic) and has cause me great pain and sorrow because I 
failed myself.  I know I cannot have a second chance to ammend what I have done, 
due to the laws and regulations of the armed forces, but if I could I would have 
warned many airmen and soldiers not to follow my path because it would lead to 
self-destruction.  I feel though if my discharge is upgraded I would have a 
second chance at getting my life back on track and getting back into the career 
field the USAF  train me in.  My Air Force career speaks for itself with numerous 
awards and decorations and the only fault or flaw was my stupid choice. 

Issue 2:  1 just want to say thanks for at least having this chance to get 

an upgrade or change for my discharge.  My Air Force career was fun, exitced 
(sic), learnful  (sic), and life experience and the only thing I would change 
would be my air force career ending decision.

SUBJECT:  Notification Memorandum 

I  am recoininending your discharge from the United States Air Force for drug abuse.  The

authority for this action is AFT  36-3208, paragraph 5.54, Drug Abuse.  If my recommendation is 
approved, your service will be characterized as honorable, under honorable conditions (general) 
or under other than honorable conditions (UOTHC).  I am recommending your service be 
characterized  as under honorable conditions (general). 

2.  My reasons for this action are: 

On or between  14 Oct 05 and  14 Nov 05, you wrongfully used marijuana.  For this offense, 
you received an Article 15 dated 23 Jan 06 with a reduction in grade from Staff Sergeant to 
Senior Airinan, and a reprimand.  In addition, an Unfavorable Information File was 
established, 

3,  Copies of the documents to be forwarded to the separation authority in support of this 
recommendation are attached.  The commander exercising Special Courts-Martial jurisdiction 
will ultimately decide whether you will be discharged or retained in the Air Force and, if you are 
discharged, how your service will be characterized.  If you are discharged, you will be ineligible 
for reenlistment in the Air Force.

4.  You have the right to consult counsel.  Military legal counsel has been obtained to assist you. 
I have made an appointment for you to consult with the Area Defense Counsel, 926-5852, at 
1000 hours on 7 Mar 06.  You may consult civilian counsel at your own expense. 

5.  You have the right to submit statements on your own behalf.  Any statements you want the 
separation authority to consider must reach me within 3 workdays of notificatioil unless you 
request and receive an extension for good cause.  I will send the statements to the discharge 
authority with the case file to be considered with this recommendation.  If you fail to respond, 
your failure will constitute a waiver of the right to submit statements on your behalf. 

6.  Any personal  information you furnish in rebuttal is covered by the Privacy Act of 1974.  A 
copy of AFI 36-3208 is available for your use at the Area Defense Counsel's  Office. 

7.  You have an appointment for an initial briefing at Separations, Bldg 905, 327-7348, at 
0900 hours on 7 Mar 06,  Please bring an escort for your assistance. 

8.  You have been scheduled for a medical examination.  You must report to Family Practice 
(Desli 4) located in Building 700A at 0830 hours on 8 Mar 06.  You must be in uniform and 
arrive 15 minutes prior to the scheduled appointment.
