GENERAL:  The applicant appeals for upgrade of discharge to honorable, to change the reason and 
authority for the discharge, and to change the reenlistment code. 

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to 
exercise this right. 

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. 

FINDINGS:  Upgrade of discharge, change of reason and authority for discharge, and change of 
reenlistment code are denied. 

The Board finds that neither the evidence of record nor that provided by the applicant substantiates an 
inequity or impropriety that would justify a change of discharge. 

ISSUE: 

Issue 1.  Applicant contends discharge was inequitable because it was too harsh and based on one isolated 
incident.  He has expressed a desire to have his discharge upgraded so that he may qualify for reenlistment 
into the armed forces.  The records indicated the applicant received a civilian conviction for driving under 
the influence of alcohol which resulted in bodily injuries.  His civilian conviction resulted in 180 days of 
confinement (90 days straight and 90 days alternative sentencing program), fined $1063.00, $200.00 
restitution fund, $250.00 probation fees, and three years probation.  The Board concluded the applicant's 
misconduct was a significant departure from conduct expected of all military members.  The characterization 
of the discharge received by the applicant was found to be appropriate. 

Issue 2.  Applicant states that his discharge did not take into account the good things he did while in the 
service. The DRB took note of the applicant's duty performance as documented by his performance reports, 
letters of recommendation and other accomplishments.  They found the seriousness of the willful misconduct 
offset any positive aspects of the applicant's duty performance.  The Board concluded the discharge was 
appropriate for the reasons which were the basis for this case. 

Issue 3.  The DRB was pleased to see that the applicant was doing well and has a good job.  However, no 
inequity or impropriety in his discharge was suggested or found in the course of the hearing.  ?'he  Board 
concluded the misconduct of the applicant appropriately characterized his term of service. 

CONCLUSIONS:  The Discharge Review Board concludes that the discharge was consistent with the 
procedural and substantive requirements of the discharge regulation and was within the discretion of the 
discharge authority and that the applicant was provided full administrative due process. 

In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for 
upgrade of discharge, thus the applicant's discharge should not be changed.

e i t h e r   on  o r   o f f   b a s e .   During  t h e   a f o r e m e n t i o n e d   d a t e s ,   I  v o l u n t e e r e d

Honor  Guard  and  D r i l l   Team  a t  Kadena  A i r   Base.  I  was  a l s o   s e l e c t e d   as

Coming  from  a  b r o k e n   home  and  p o v e r t y ,  
n e v e r   had  b e f o r e ;   s e l f - c o n f i d e n c e ,   s e l f   r e s p e c t ,   a n d   a  f e e l i n g   o f  
s e r v i n g   something  g r e a t e r   t h a n   m y s e l f .   T h i s   was  a l l  t a k e n   away  t h e   f i r s t  
t i m e   I  made  a   m i s t a k e .   I  do  n o t   blame  anyone  o t h e r   t h a n   m y s e l f .   I  have 
no  bad  f e e l i n g s   t o w a r d s   anyone  i n  my  c h a i n   o f   command.  I  h e a r d   a n d  
u n d e r s t a n d   t h a t   my  commander  was  t r y i n g   t o  make a n   example  of  me  t o  
everyone  e l s e   i n  my  u n i t   and  I  c a n ' t   blame  him  f o r   d o i n g   t h a t .   I  would 
have  done  t h e   same  t h i n g   had  I  been  i n  h i s   s h o e s .   However,  I  d o n ' t   feel 
that t h e   c h a r a c t e r i z a t i o n   o f   my  d i s c h a r g e   i s   f a i r   a n d   I  d o n ' t   f e e l   t h a t  
b e i n g   e x p e l l e d   from  s e r v i n g   my  c o u n t r y   i s   j u s t i f i e d .   I  gave  t h e   A i r  
Force  110% e v e r y   day  f  s e r v e d .   The  l a p s e   i n  judgment  was  n o t   one  t h a t  
happened  on  d u t y   o r   even  on  b a s e ,   I t   happened  i n  t h e   m i s t   of  c e l e b r a t i n g  
a  f r i e n d s   b i r t h d a y   on  a   F r i d a y   e v e n i n g .   I  have  had  c l o s e   t o  s e v e n   y e a r s  
t o  t h i n k   a b o u t   it  a n d   I  know  t h a t   it  was  n o t   s o m e t h i n g   t h a t   s h o u l d  
d e f i n e   who  I  am,  my  c h a r a c t e r ,   o r   what  I  d o   i n   t h e   f u t u r e .  
I  have  moved  on  w i t h   my 
and  s u p e r v i s e d   1 4 0   a p a r t m e n t   u n i t s   f o r   f i v e   y e a r s .   During  which  t i m e ,   I 
a l s o   r a n   a  b u s i n e s s   r e m o d e l i n g   homes  i n  Lake  Tahoe  a n d   since t h e n   have 
e a r n e d   my  G e n e r a l   C o n t r a c t o r   l i c e n s e   i n  C a l i f o r n i a .   When  my  ex-wife 
a   TSgt  i n  t h e   a c t i v e   A i r   F o r c e )   had  t o  d e p l o y   t o   I r a q   l a s t   y e a r ,   I  gave 
up  my  j o b   and  moved  b a c k   t o   t h e   b a s e   t o   t a k e   c a r e   o f   o u r   s o n .   I  worked 
a s   a  c o n t r a c t o r   i n   t h e   l o c a l   a r e a   f o r   s i x  months  w h i l e   s h e   was  d e p l o y e d .  
A f t e r   s h e   r e t u r n e d   from  TDY,  I  moved  back  h e r e   t o  Lake  Tahoe  a n d   s t a r t e d  
work  f o r   a   l a r g e   e l e c t r i c a l   c o n t r a c t o r   o u t   o f   Reno,  Nevada  working  as  a  

l i f e   s i n c e   t h e n .   A f t e r   my  d i s c h a r g e ,   I  managed

commercial  e l e c t r i c i a n .   I  am  s t i l l  working  f o r   Electro-Tech, 
e n j o y   t h e   work  and  e x p e r i e n c e   immensely.  These  i s  s t i l l   something 
missing  i n  my  l i f e  though.  Something  t h a t   I  would  l i k e   t o   e x p e r i e n c e  
a g a i n   i n  t h e   f u t u r e .  
I  m i s s   s e r v i n g   my  c o u n t r y .   E s p e c i a l l y   w i t h   a l l  the e v e n t s   t h a t   a r e  
c u r r e n t l y   u n f o l d i n g   i n  o u r   world.  The  t e r r o r i s t   a t t a c k s   an  t h e   world 
t r a d e   c e n t e r ,   t h e   war  on  t e r r o r i s m   i n  Afghanistan,  h e l p i n g   I r a q   t o  
become  a  democracy,  I s r a e l   a t   war  w i t h   i t s   neighbor,  I r a n   producing 
n u c l e a r   e n e r g y   and  t o d a y   s u c c e s s f u l l y   t e s t   f i r i n g   a   long-range  sub  t o  
s u r f a c e   m i s s i l e   i n   t h e   P e r s i a n   Gulf.  A  l o t   i s   going  on  i n  t h e   world  and 
a t  home.  A t   home  t h e   problems  we've  had  w i t h   i l l e g a l   immigration  on  t h e  
Mexican  b o r d e r   h a s   r e a l l y   p u t   a   s t r e s s   on  our  m i l i t a r y   b o t h   active and 
r e s e r v e s .   We  have  N a t i o n a l   Guard  members  on  t h e i r   t h i r d   and  f o r t h   t o u r s  
i n   I r a q   and  now  w e   a r e   a s k i n g   them  t o  p a t r o l   t h e   Mexican  Border. 
P r e s i d e n t   Bush  h a s   r e c o g n i z e d   t h a t   t h e r e   a r e   c u r r e n t l y   1 2  m i l l i o n  
i l l e g a l   p e o p l e   i n   o u r   c o u n t r y .   The  P r e s i d e n t   h a s   o u t l i n e d   a  two  y e a r  
program  t h a t   would  keep  6,000  N a t i o n a l   Guard  t r o o p s   on  t h e   b o r d e r .   This 
i s   e s t i m a t e d   t o   r e q u i r e   up  t o   156,000  t r o o p s   i n   a l l .   Perhaps  t h a t   i s  why 
t h e   m i l i t a r y   h a s   d e c i d e d   t o  r a i s e   t h e   r e q u i r e d   e n l i s t m e n t   age  t o   4 2 .   I 
am  c u r r e n t l y   36  and  I  may  never  have  a n o t h e r   chance  t o   s e r v e   my  c o u n t r y  
i n   time  of  need.  So,  I  r e s p e c t f u l l y   r e q u e s t   t h a t   my  e n t i r e   r e c o r d   be 
reviewed  and  t h a t   my  d i s c h a r g e   be  upgraded  t o  Honorable  and  my 
e n l i s t m e n t   code  be  changed  s o   t h a t   I  can s t a n d   s h o u l d e r   t o   s h o u l d e r   with 
my  b r o t h e r s   and  s i s t e r s   i n   arms  t o  p r o t e c t   and  defend  o u r   g r e a t   c o u n t r y .

2.  My reason for this action is that on or about 13 Jul 00, you were convicted of the crime of 
driving under the influence of alcohol, in violation of 23 153(b) Vehicle Code with 2 Penal Code 
Section 12022.7(a) enhancement by  the  Superior Court of California,  County of  Solano.  This 
offense resulted in injuries to two people.  Sentence adjudged by the State of California, Superior 
Court of Solano County was  180 days confinement in the Solano County Jail  (90 days straight 
time  and  90  days  alternative  sentence  program),  $1,063.00  fine,  $200.00  restitution  fund, 
$250.00 probation fees, and 3 years probation (ordered to appear for progress report on  11 Jan 
01).  This is evidenced by Case No. FCR  180828, Minute Order and Probation Order, dated 3 Jul 
00 (Atch 2, Tab 1). 

3.  This discharge action could result in your separation with a service characterization of under 
other  than  honorable  conditions (UOTHC),  I  am  recommending  that  you  receive  a  general 
discharge.  The  commander exercising SPCM jurisdiction  or a higher  authority will make the 
final decision in this matter.  If you are discharged, you will be ineligible for reenlistment in the 
Air Force and will probably be  denied enlistment in any component of the armed  forces, and 
"any special pay, bonus, or education assistance funds may be subjected to recoupment." 

4.  You have the right to:

Military Justice.  In addition to military counsel, you have the right to employ civilian counsel. 
The Air Force does not pay expenses incident to the employment of civilian counsel.  Civilian 
counsel, if employed, must be readily available. 

6  Confer with your counsel and reply, in writing, within 7 workdays, specifying the rights you 
choose to exercise.  The statement you  submit must be signed in the presence of your counsel 
who  also will  sign it.  If you waive your right to  a hearing before an administrative discharge 
board, you may submit written statements on your behalf.  I will send the statements you submit 
to the discharge authority with the case file to be considered with this recommendation.  If you 
fail to respond, your failure will constitute a waiver of the right to the board hearing. 

7.  If you  request  a board  and  you  fail to  appear without  good  cause, your  failure to  appear 
constitutes a waiver of your right to be present at the hearing. 

8.  Any personal information you furnish in rebuttal is covered by  the Privacy Act of  1974.  A 
copy of AFI 36-3208 is available for your use in the orderly room. 

9.  Execute the attached acknowledgment and return it to me immediately.
