GENERAL:  The  applicant  appeals  for  upgrade  of  discharge  to  honorable,  to  change  the  reason  and 
authority for the discharge, and to change the reenlistment code. 

The applicant was offered a personal  appearance before the Discharge Review Board (DRB) but declined to 
exercise this right. 

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. 

FINDINGS:  Upgrade  of  discharge,  change  of  reason  and  authority  for  discharge,  and  change  of 
reenlistment code are denied. 

The  Board  finds  that  neither  the  evidence  of  record  nor  that  provided  by  the  applicant  substantiates  an 
inequity or impropriety that would justify  a change of discharge. 

ISSUE: 

Applicant contends discharge was inequitable because it was too harsh and based on one isolated incident in 
46 months of service.  The records indicated the applicant received an Article  15 for misconduct.  The 
Article  15 was for wrongful use of marijuana.  He was punished with a reduction in grade to Airman First 
Class and a suspended forfeiture of pay.  The Board concluded the applicant's  misconduct was a significant 
departure from conduct expected of all military members.  The characterization of the discharge received by 
the applicant was found to be appropriate. 

CONCLUSIONS:  The  Discharge  Review  Board  concludes  that  the  discharge  was  consistent  with  the 
procedural  and  substantive  requirements  of the  discharge  regulation  and  was  within  the  discretion  of  the 
discharge authority and that the applicant was provided full administrative due process. 

In view of the foregoing findings, the Board  further concludes that there exists no legal or equitable basis for 
upgrade of discharge, thus the applicant's discharge should not be changed.

To Whom It May Concern: 

My discharge is improper because the basis for my discharge, as well as the narrative 
reason for separation, are represented in the wrong light and is left too open for 
interpretation.  The basis was drug abuse or use of a controlled substance, which the 
statement in itself allows for ones own interpretation and opinions to take over, 
transforming your perception, and just as in a sexual harassment case perception is, for 
the most part, reality.  My actual offense was using hemp juices as well as oils for healthy 
alternative cooking and eating. These products are legally available at numerous 
nutritional, health, and organic stores.  My question is, how can I be judged so harshly 
and generally if the offease was committed unlmowingly, not to mention no infarmation 
was made available by the United States Air Force at any level on such products and their 
potential to show up on a random drug screen.  To be accountable one must know all the 
facts, or at the very least the pertinent ones.  Airmen received no such restrictions or 
warnings of any kind for these products or similar products.  Thank you for your time and

SUBJEC.T; Notification Memorandum 

1. I am recommending your discharge from the United States Air Force for drug abuse.  The 
authority for this action is AFPD 36-32 and AFI 36-3208, Chapter 5, Section H, Paragraph 
5.54.  If your discharge is approved, your service will be characterized as honorable or under 
honorable conditions (general) or under other than honorable conditions.  I am recommending 
that your service be characterized as under honorable conditions (general). 

2.  My reason for this action is that between on or about 18 May 01 and 18 Jun 01, you 
wronghlly used marijuana as evidenced by a positive urinalysis test (see Attachment la).  You 
received nonjudicial punishment on 28 Aug 01, which consisted of a reduction to Airman First 
Class, suspended forfeiture of $644.00 pay. 

3.  Copies of the documents to support this recommendation are attached and will be forwarded 
to  the  separation  authority.  The  separation  authority  will  make  the  frndings  and 
recommendations  required  under  10  U.S.C. 2005(g)  regarding  recoupment  of  education 
assistance funds, if applicable.  The commander exercising special court-martial jurisdiction or 
a higher authority will decide whether you will be discharged or retaiued in the Air Force and, if 
you are discharged, how your service will be characterized.  If you are discharged, you will be 
ineligible for reenlistment in the Air Force and any special pay,  bonus, or education assistance 
funds may be subject to recoupment. 

4.  You have the right to  consult counsel.  Military legal counsel has been  obtained to  assist
