GENERAL: The applicant appeals for upgrade of discharge to honorable, to change the reason and
authority for the discharge, and to change the reenlistment code.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDINGS: Upgrade of discharge, change of reason and authority for discharge, and change of
reenlistment code are denied.
The Board finds that neither the evidence of record nor that provided by the applicant substantiates an
inequity or impropriety that would justify a change of discharge.
ISSUE:
Applicant contends discharge was inequitable because it was too harsh. He contends that he was punished at
Keesler AFB with 30 days of correctional custody and reduction in rank. He feels his life should not be
ruined for disciplinary infractions in which he already received punishment. The records indicated the
applicant received two Article 15's, and a Vacation for misconduct. The first Article 15 was for providing
alcohol to an airman under the age of 2 1. He received a suspended reduction to airman basic and 30 days of
correctional custody. The Vacation action was for failure to go to appointed place of duty. This action
resulted in his reduction in grade to airman basic. The second Article 15 was for failure to report to the First
Sergeant's office. He was punished with restriction to the limits of Eglin AFB for 14 days and 14 days of
extra duty. The DRB opined that through these administrative actions, the applicant had ample opportunities
to change his negative behavior. The Board concluded the misconduct was a significant departure from
conduct expected of all military members. The characterization of the discharge received by the applicant
was found to be appropriate.
CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.
In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.

just never gave any thought of how old he was or the age of anyone else in our circle of
guys I ran around with, When you eat, sleep, P.T., live and go to class and go through all
the same military experiences these guys are all you know. You do everything together. I
know I showed poor judgment drinking with him. But nobody's judgment is good when
alcohol is involved, I was sent to Keesler AFB for 30 days of correctional custody. I
don't even know how to begin to tell you what 30 days of CC did to me. It's an
experience to me a nightmare I will remember the rest of my life. The prison guards at
Abu Greib prison didn't have anything on this kind of punishment. Only we weren't
physically beaten not at the hands of someone else but they had other ways of physically
beating us things 1 did there:
1. Digging holes in the sandpit ALL DAY then filling them back in. Then starting
3. Raking leaves when there werc no leaves to rake. But you considered it a good
day without a shovel in your hand.
4. Being told to get in full dress uniform. Then being told to run behind a jeep and
to keep up with it for miles in the summer heat.
5. Being fed a full meal and getting P.T. until you threw up or passed out or both. I
was always being told to do someone else's push-ups, sit-ups, and pull-ups. There
was a female in the group that I was order to do hers after she fell over from
exhaustion. This was an everyday basis. I was always singled out to do her left
over tasks. I am a very muscular and physically fit person. This guy was in my
face everyday doing this, he told me he would break me, he said I eat steroids and
wash them down with beer. He'd get angrier when I wouldn't agree with that
remark and P.T. me all the more, Rut I never lost my military bearing like many
did. I would like to say I had no respect for anyone that ordcrs you to do
something they've never done themselves. I also want to say I've never been a
violent person. I could never severely harm another person just for kicks. I
couldn't even hunt animals with my dad growing up because I couldn't kill
things. But I went to bed every night there with murderous thoughts for that guy,
and that's NOT me. I was so afraid of what I was becoming being there. The only
way 1 could cope was to put my mind somewhere else thinking of good times
with my family and friends at home, shutting this guy out. I went through this
daily physical abuse. It served no purpose in correction. This guy loved his job.
6. To use the bathroom there were 6 red lines in the hall. You stood witb your toes
on the line and gave a 6 part reporting statement before crossing to the next line
then you did it all over again at each line. I heard those reporting statements in my
head long after I left there. 1 even found myself looking down at the floor for red
lines when I didn't have to anymore.
7. Sleep depravation we laid down for 6 hours. You got up for 2 hours to walk the
halls on your watch every night. So you weren't allowed to rest at night if you
were in your room during the day which was rare. You stood and did not get to sit
in your room, so we weren't off our feet much,
8. Given impossible tasks like digging a 4-4 trench after P.T. all day or running
behind the jeep. They knew you were already physically exhausted.
These are the kinds of things you had to look forward to everyday. This was a place
of sevelzpunishment aimed at breaking your moral. It wasn't a correctional institute.
And the people running this place took great pleasure in their jobs. So you have to put
their character into question. To abuse and humiliate fellow Americans, their own, for
no good reason. We didn't commit a major crime they have no consciences. I
couldn't make myself treat my fellow man like that even if ordered to do so.

Society bas a label for people like sociopaths. And I truly believer those were the
types of people in charge. Inmates on death row, the condemned aren't treated like we
were and they've murdered people. All I did was drink with a minor. The punishment
definitely didn't fit my crime. That place left a bad taste in my mouth, It did
something to me, to my moral, my emotional state. I didn't want to be around anyone,
I felt alone. 1 just didn't care anymore about being an airman. I couldn't respect
authority that would do such heinous things to their own men. That place was overkill
and at times I thought it would kill me or I'd kill me. I tried to get back to normal but
I just didn't want it anymore. I wanted my civilian life again, something normal to be
around people who loved me. The other two incidents I will try to explain a little.

him. He thought it might do me some good to spend the day with his family. I told
him everything I'm telling you and that I was going to ask for separation because I
was going down in rank to E-1 . I told him how I felt about things and how that loss of
money would hurt me financially. I also worked on the side at Circuit City to boast
my pay, but had to quit when I was put on 14 days base restriction. I told him 1 had to
get out because I couldn't stand the thought of losing my truck. I bought that truck
brand new on my own. My parents co-signed my previous vehicle I proved myself
with my creditors. That shows I'm a responsible person to be able to buy a $30,000
truck on my own at the age of 1 9. I had many sleepless nights wowing about how I
was going to make my payments on top of insurance and other monthly expenses

Had my truck been repossessed my credit would have been ruined. You can't have
anything in this life with bad credit. My truck was all I had that made me feel like me.
And 1 wasn't losing that too. So I went to the commander and begged to be left out of
the military. I would like to prove my good character please read S S G T n

work ethic, I was selected out of a few to work in the central office. PLEASE READ

3. Being a guidon bearer is a honor I was chosen for but had to give it up because I
got to nervous. But somebody seen something in me I never had a 341 pulled, that

should tell you something about my character. And giving more than 100% to my
employer is just my way. I worked hard to study for my CDC's, because I knew how
important they were to pass. Worrying about my credit shows maturity. Please take
all of this and the punishment I received into consideration when making your
decision. MISCONDUCT labels me as a bad person. I'm not a bad person I just did a
bad thing, for which I paid. Don't punish me further for a crime of the past with my
future.
