GENERAL: The applicant appeals for upgrade of discharge to honorable.

The applicant was offered a personal appearance before the Discharge Review Board but declined to
exercise this right.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDINGS: Upgrade of discharge is denied.

The Board finds the applicant submitted no issues contesting the equity or propriety of the discharge, and
after a thorough review of the record, the Board was unable to identify any.

Issues. Applicant was discharged for misconduct, conduct prejudicial to good order and discipline. He had
six Letters of Reprimand, three Records of Individual Counseling, and an Article 15. His misconduct
included two instances of failure to obey lawful orders, two incidents of dereliction of duty, at least two
instances of failure to maintain his uniforms and personal hygiene standards, failure to go, failing to follow
government vehicle operating instructions resulting in an accident, violating the base visitor sponsorship
policy, providing alcoholic beverages to another airman who was under the legal drinking age, and
soliciting that airman to make a false statement. He also had an Enlisted Performance Report rated an
overall referral “1” wherein five of seven front side evaluation areas were marked in the lowest possible
blocks. Member’s misbehavior and substandard performance were thoroughly documented in the record.
The Board noted that when his misconduct occurred, member was age 21 to 22 and there was no evidence -
he did not know right from wrong, so he was held accountable for his actions. Although given many
opportunities to correct or improve his behavior, he was unable or unwilling to do so. At the time of the
discharge, member waived his right to consult counsel or to submit a statement in his own behalf. The
record review offered no basis to substantiate an upgrade to his discharge characterization. The Board
could find no wrongful action by the Air Force, nor an inequity or impropriety.

CONCLUSIONS: The Discharge Review Board concludes that the discharge was essentially consistent
with the procedural and substantive requirements of the discharge regulation and was within the discretion
of the discharge authority and that the applicant was provided full administrative due process.

In view of the foregoing findings the board further concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.

SUBJECT: Notification Letter

1. Iam recommending your discharge from the United States Air Force for a pattern of
misconduct prejudicial to good order and discipline. The authority for this action is AFPD 36-32
and AFI 36-3208, paragraph 5.50.2. If my recommendation is approved, your service will be
characterized as honorable or general. I recommend your service be characterized as general

2. My reason for this action is as follows:

a. On or about 11 Dec 96, you provided alcoholic beverages to kan
individual under the lawful age of 21. On or about 13 Dec 96, you wrongfully solicited’
to make a false official statement to conceal involvement in

" providing alcohol to her. For this misconduct, you were putusneu unuer Article 15 on 16 Jan 97.
Punishment consisted reduction to Airman Basic and 60 days restriction to Grand Forks Air

Force Base. (Attachment A)

b. On or about 24 Aug 96, you failed to go at the time prescribed to your appointed place
of duty. For this misconduct, you received a LOR dated 23 Sep 96, an Unfavorable Information
File (VIF) entry was made. (Attachment B)

¢c. On or about 19 Aug 96 an on or about 21 Aug 96, you disobeyed a lawful order from
to complete training daily as your primary duty. For this misconduct, you received a

d. On or about 3 Jun 96, you disobeyed a lawful regulation, AFI 36-2903, by failing to
maintain your uniform and hygiene standards. For this misconduct, you received a LOR dated

you received a LOR dated 10 Feb 96, a UIF entry was made, and you were placed on the Control

g. On or about 1 Feb 96, you had an accident with a government owned vehicle. Also,
you failed to follow operating instructions by not inspecting the vehicle prior to use and failed to
use a spotter when the vehicle was being backed-up. For this misconduct, you received a LOR
dated 10 Feb 96, a UIF entry was made, and you were placed on the Control Roster.

h. On or about | Feb 96, you disobeyed a 26 Jan 96 lawful order from touse ,.
a notebook to log in all study time for your career development course. For this misconduct, you
received a LOC dated 6 Feb 96. (Attachment H)

i. On or about 22 Dec 95, you were derelict in the performance of your duties in that you
willfully failed to maintain insurance on your car. For this misconduct, you received a LOR
dated 22 Dec 95, and a UIF was established. (Attachment I)

j- On or about 22 Nov 95, you failed to go at the time prescribed to your appointed place
of duty. For this misconduct, you received a LOC dated 27 Nov 95. (Attachment J)

3. Copies of the documents to be forwarded to the separation authority in support of this
recommendation are attached. The Commander exercising SPCM jurisdiction or higher
authority will decide whether you will be discharged or retained in the Air Force. If you are
discharged, you will be ineligible for reenlistment in the Air Force.

4. You have the right to consult counsel. Military legal counsel has been obtained to assist you.
You have been scheduled an appointment at the Office of the Area Defense Counsel at Building
216 onZ0 77 at _6&69 hours. You may consult civilian counsel at your own expense.

5. You have the right to submit statements in your own behalf. Any statements you want the

separation authority to consider must reach me by 24 fes//at 1450 hours unless you request
and receive an extension for good cause shown. I will send them to the separation authority.

6. If you fail to consult counsel or to submit statements in your own behalf, your failure will
constitute a waiver of your right to do so.

7. You have been scheduled for a medical examination. You must report to the 319th Medical
Group on2Z! Fe@)77_ at_ 1400 hours for the examination. »

 

8. Deliver to me immediately your military identification card and those of your dependents. I
have requested that temporary identification cards be issued IAW AFR 36-3001, paragraph 4.2.
