APPLICANT REQUESTS THAT:
His record, to include an Air Force Commendation Medal, Second
Oak Leaf Cluster (AFCM, 2OLC) awarded for the period 7 Jul 10 to
19 Sep 11, be considered for promotion by a Special Selection
Board (SSB) for the P0411D Major Central Selection Board (CSB).

APPLICANT CONTENDS THAT:
Due to an administrative oversight his AFCM (2OLC) was not
signed until 21 Dec 11. AFI 36-2803, The Air Force Awards and
Decorations Program, states “the effective date of all
decorations is the closing date of the service period
recognized” which in his case is 19 Sep 11.
On 19 Sep 11, he made a Permanent Change of Station (PCS) move;
however, due to a delay in signing the decoration, it was not
filed in his OSR. The absence of his decoration resulted in the
exclusion of performance information and directly affected his
non-selection for promotion to the grade of major.

STATEMENT OF FACTS:
The applicant is currently serving in the Regular Air Force in
the grade of captain.
On 16 Aug 11, a Recommendation for Decoration Print-out was
prepared on the applicant for the purpose of recommending him
for an end-of-tour decoration based on his selection for a PCS.
The applicant was considered but not selected for promotion to
the grade of major by the P0411D Maj CSB which convened on
5 Dec 11.
On 12 Jan 12, he was awarded the AFCM.

AIR FORCE EVALUATION:
AFPC/DPSOO recommends denial. DPSOO states the applicant’s AFCM
(2OLC) was processed within the guidelines of AFI 36-2803, which
states decoration recommendations are entered “into official
channels within two years and awarded within three years of the
act, achievement, or service performed.” Furthermore, IAW
published guidance; the decoration award authority announces its
final decision once the special order (SO) number is assigned to
the citation. In the applicant’s case, the AFCM was awarded on
12 Jan 12, by SO GD-018. As such, since the decoration was
awarded over one month after the P0411D CSB convened, the
citation could not have been filed in his OSR or reflected in
any official personnel data systems and subsequently on the
officer selection brief (OSB) when the board convened on
5 Dec 11.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 6 Aug 12, for review and comment within 30 days
(Exhibit C). As of this date, this office has not received a
response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we agree with the opinion and recommendation
of the Air Force office of primary responsibility and adopt its
rationale as the basis for our conclusion the applicant has not
been the victim of an error or injustice. The statement from
the applicant’s current squadron commander is duly noted;
however, it does not substantiate the contention that due to
administrative oversight, the decoration was not signed until
after the P0411D Major CSB had convened.
Therefore, in view of the above and in the absence of a
statement from a member of the applicant’s former rating chain,
indicating that it was their intent to have the decoration
approved and in his records prior to the convening of the P0411D
Major CSB, we find no basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of an error or injustice; that the
application was denied without a personal appearance; and that
the application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.

The amended decoration was approved on 24 Sep 08, after the 12 May 08 convening board date, and cannot be filed in her Officer Selection Record (OSR) for the CY08A CSB. The special order date, which authorizes the decoration, is the same as the “Given Under My Hand” date. By having the MSM in her promotion record, the promotion board would have seen that although she did not receive a definitely promote, the MSM, 2OLC would have projected that she continued to demonstrate outstanding performance.
