APPLICANT REQUESTS THAT:
1. His Date of Rank (DOR) and Promotion Effective Date (PED)
from airman basic (E-1) to airman (E-2) be changed to 22 Oct 11.
2. He be promoted to the grade of airman first class (E-3) with
a date of rank and promotion effective date of 22 Mar 12.

APPLICANT CONTENDS THAT:
In accordance with the Air Force Reserve Command (AFRC) policy,
he should have been promoted to E-2 after six months, but
because of an administrative oversight he did not get promoted.
He provides a letter from his unit commander that states he was
not denied promotion; his name just never appeared on the
promotion roster.
In support of his request, the applicant provides a copy of the
promotion eligibility criteria, a printout from the Military
Personnel Data System (MilPDS), a copy of a letter from his
commander, and a printout on the Reserve enlisted promotions.

STATEMENT OF FACTS:
The applicant is currently serving in the Air Force Reserve in
the grade of airman (E-2) with a DOR of 1 Sep 12.
The remaining relevant facts pertaining to this application are
contained in the letter prepared by the appropriate office of
the Air Force, which is at Exhibit C.

AIR FORCE EVALUATION:
AFRC/A1K recommends partial approval. The applicant would have
been eligible for promotion to the grade of E-2 on 7 May 12,
after completing Basic Military Training (BMT) and 6 months Time
in Grade (TIG); with approval of the promotion authority. He
would have been eligible for promotion to the grade of E-3 on
7 Nov 12. Therefore, based on the documentation provided in the
form of his commanders recommendation and a MilPDS printout,
partial approval is recommended.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 8 Jan 13 for review and comment within 30 days. As
of this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of error or injustice warranting
partial approval. The applicants request that his DOR for
airman be changed to 22 Oct 11 and he be promoted to the grade
of senior airman with a DOR of 22 Mar 13 is noted. However,
after reviewing the circumstances surrounding the applicants
promotion date of ranks and promotion effective dates, we agree
with the opinion and recommendation of the Air Force office of
primary responsibility. We believe the recommended corrections
to his records provide full and fitting relief. Therefore, we
recommend his records be corrected as indicated below.
4. The applicant's case is adequately documented and it has not
been shown that a personal appearance with or without counsel
will materially add to our understanding of the issues involved.
Therefore, the request for a hearing is not favorably
considered.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air
Force relating to APPLICANT be corrected to show that:
a. He was promoted to the grade of airman (E-2) effective
and with a date of rank of 7 May 2012 rather than 1 September
2012.
b. He was promoted to the grade of airman first class (E-3)
effective and with a date of rank of 7 November 2012.

Upon completing the Article 15 punishment action, the applicant became eligible for promotion the following day to the rank of Airman, (E-2). Based on documentation, (AF Form 3070A), provided, the request to adjust the applicant’s promotion eligibility date (PED) and Date of Rank (DOR) meets the basic requirements for correction of his promotion history to 23 June 2011 versus 1 July 2011, his requested date.

On 8 November 2011, the applicants DD Form 4 and DD Form 1966 were corrected to reflect he entered the Air Force in the pay grade of E-2.
