APPLICANT REQUESTS THAT:
Her promotion effective date (PED) to the grade of airman (E-2)
be changed to 21 Mar 11.

APPLICANT CONTENDS THAT:
She should have been promoted to Airman on time, but she wasn’t.
She had not done anything which would prevent her from being
promoted on time, and she wasn’t denied promotion. She should
receive her back pay as an Airman.
On 3 Dec 11, her commander, the 94th Force Support Squadron
Commander, recommended approval of her request to change her DOR
to E-2 to 21 Mar 11.
In support of her appeal, the applicant provides a memorandum of
endorsement signed by her commander.

STATEMENT OF FACTS:
The applicant initially entered the Air Force Reserve (AFR) as
an Airman Basic (E-1) on 21 Sep 10 and served on active duty for
her initial training. She was released from active duty upon
completion of her initial training on 15 Jun 11, and credited
with 8 months and 25 days active service. The applicant
currently serves in the Air Force Reserve (AFR) in the grade of
Airman.
The remaining relevant facts pertaining to this application are
described in the letter prepared by the Air Force office of
primary responsibility which is included at Exhibit C.

AIR FORCE EVALUATION:
AFRC/A1K recommends approval, indicating there is an error or
injustice. The applicant entered active duty training in the
grade of airman basic (E-1) on 27 Sep 10 and in accordance with
AFR enlisted promotion policy, her time in grade (TIG) for E-1
was effective as of that date. IAW AFPD 36-25, Military
Promotion and Demotion, Paragraph 3.1, upon completion of Basic
Military Training (BMT) and six months TIG as an E-1 the
applicant was eligible for promotion to the rank of E-2 as of 27
Mar 11. While the applicant is requesting her promotion to the
grade of airman (E-2) be effective on 21 Mar 11, she was not TIG
eligible for said promotion until 27 Mar 11. Therefore,
contingent upon the concurrence of the promotion authority for
this applicant, her records should be corrected to reflect she
was promoted to the grade of airman (E-2) on 27 Mar 11.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 10 Apr 12 for review and comment within 30 days.
As of this date, no response has been received by this office.
(Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was untimely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. The
applicant contends that her promotion effective date (PED) to
the rank of Airman (E-2) should be 21 Mar 11. After a thorough
review of the evidence of record and the applicant’s submission,
we believe a preponderance of the evidence supports corrective
action. We note the comments of AFRC/A1K indicating the
applicant entered initial active duty training on 27 Sep 10, and
would have been eligible for promotion to E-2 on 27 Mar 11;
however, her DD Form 214, Certificate of Release or Discharge
from Active Duty, indicates that she initially entered active
duty on 21 Mar 11. Therefore, in view of the above, we
recommend her records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air
Force relating to the APPLICANT be corrected to show that she
was promoted to the grade of airman (E-2), effective and with a
date of rank of 21 March 2011.

His date of rank (DOR) and effective date of promotion is 1 December 2011. Upon completing the Article 15 punishment action, the applicant became eligible for promotion the following day to the rank of Airman, (E-2). Based on documentation, (AF Form 3070A), provided, the request to adjust the applicant’s promotion eligibility date (PED) and Date of Rank (DOR) meets the basic requirements for correction of his promotion history to 23 June 2011 versus 1 July 2011, his requested date.
