RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2012-05059
COUNSEL: NONE
HEARING DESIRED: NO
________________________________________________________________
APPLICANT REQUESTS THAT:
Her Date of Rank (DOR) to the grade of Airman (E-2) be changed
to 11 May 10.
________________________________________________________________
APPLICANT CONTENDS THAT:
There is confusion as to whether her DOR to E-2 is 11 May 10 or
14 Jan 11. She initially entered the Air Force as an E-2 on
11 May 10 and that should be her correct DOR. She had a break
in service from 4 Nov 10 until 14 Jan 11, at which time she
reenlisted in the Reserve.
The applicants complete submission, with attachments, is at
Exhibit A.
_________________ ______________________________________________
STATEMENT OF FACTS:
The applicant initially entered the regular Air Force on
11 May 10.
On 4 Nov 10, she was furnished an Entry Level Separation with
uncharacterized service.
On 14 Jan 11, the applicant enlisted in the AF Reserve.
The remaining relevant facts pertaining to this application are
described in the letter prepared by the Air Force office of
primary responsibility, which is attached at Exhibit C.
________________________________________________________________
AIR FORCE EVALUATION:
AFRC/A1K recommends denial indicating there is no evidence of an
error or an injustice. The applicant had a 2 month and 10 day
break in service. In accordance with (IAW) AFI 36-2604, Service
Dates and Dates of Rank, her DOR to E-2 should have been
adjusted from its original date of 11 May 10 to 21 Jul 10 to
account for the break in service. IAW the Air Force Reserve
Enlisted Promotion Policy, Reservists are promoted to E-3 when
they have six months time-in-grade (TIG) and are approved by the
promotion authority. Therefore, the applicants correct DOR to
E-3 should be 21 Jan 11, six months after 21 Jul 10. For
promotion to E-4, Reservists must have eight months TIG and one
year of satisfactory service. Therefore, her correct DOR to E-4
is 21 Sep 11, eight months after 21 Jul 11. The applicants
promotion history in the Military Personnel Data System (MilPDS)
accurately reflects her DOR to E-4 as 21 Sep 11. Recommend
denial of the applicants request.
A complete copy of the AFRC/A1K evaluation is at Exhibit C.
________________________________________________________________
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 28 May 13 for review and comment within 30 days.
As of this date, no response has been received by this office
(Exhibit D).
________________________________________________________________
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. We took
notice of the applicants complete submission in judging the
merits of the case; however, we agree with the opinion and
recommendation of the Air Force office of primary responsibility
(OPR) and adopt its rationale as the basis for our conclusion
the applicant has not been the victim of an error of injustice.
Therefore, in the absence of evidence to the contrary, we find
no basis to recommend granting the relief requested.
________________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
