AIR FORCE EVALUATION:
ARPC/DPT recommends denial. After reviewing the applicants
records, DPT found no records to show that he was placed on
extended active duty orders that would establish he was on active
duty until 12 Mar 59. However, they did find Reserve Order
Number 6 that reflects effective 3 Mar 59 he was released from
active duty training. Additionally, his record contained
DD Forms 220, Active Duty Report, for the period covered by the
aforementioned NA Form 13038.
The complete DPT evaluation is at Exhibit C.

A copy of the Air Force evaluation was forwarded to the applicant
on 26 Nov 12 for review and comment within 30 days. As of this
date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we agree with the opinion and recommendation
of the Air Force Reserve office of primary responsibility and
adopt its rationale as the basis for our conclusion that the
applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence the applicant performed any
active duty service, other than for training, we find no basis to
recommend granting the relief sought in this application.
_________________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.

However, the additional time was not credited to the applicants total active federal military service date (TAFMSD) while he was still serving on active duty as a Regular Air Force commissioned officer. Therefore, the time was not accounted for on his 30 Sep 2012, DD Form 214. They recommend reversal of the previously approved addition of two months of active duty service to the applicants 30 Sep 2004 DD Form 214 by ARPC/DPTS.
