APPLICANT REQUESTS THAT:
His DD Form 214, Certificate of Release or Discharge from Active
Duty, reflect the following:
1. The Korean Defense Service Medal (KDSM) administratively
corrected.
2. The Joint Meritorious Unit Award (JMUA).

APPLICANT CONTENDS THAT:
His military record is incomplete. The requested awards were
earned while on active duty; however, the awards were not
approved until after his retirement.
In support of his request, the applicant provides copies of his
Officer Effectiveness Reports.

STATEMENT OF FACTS:
On 30 September 1994, the applicant was relieved from active duty
and retired on 1 October 1994, in the grade of colonel. He
served 27 years and 6 days on active duty with 17 years, 5 months
and 25 days of foreign service.
HQ AFPC/DPSIDRA was able to verify the applicants entitlement to
the KDSM. The applicants record will be updated by the
appropriate office.

AIR FORCE EVALUATION:
AFPC/DPSIDRA recommends denial of the JMUA. DPSIDRA states in
accordance with the DoD 1348.33M, AP2.1.2.2., the JMUA is awarded
in the name of the Secretary of Defense to joint activities for
meritorious achievement or service, superior to that which is
normally expected, under any of the following conditions: during
action in combat with an armed enemy of the United States, in a
declared national emergency situation, or under extraordinary
circumstances that involve national interest.
According to the DoD 1348.33M, AP3, SUSLAK received award of the
JMUA with an inclusive period of 1 March 1991 to 28 February
1994. Documentation provided by the applicant verifies he was
assigned to the 6903rd Electronic Security Group, Yongsan AIN,
Korea, from August 1988 to July 1992. According to the
applicants OPR covering his service at Yongsan AIN, Korea, part
of his key duties included serving as the senior military advisor
to the Chief of Station, SUSLAK and performing as station chief
in the absence of the Chief, SUSLAK. The applicant was not
directly assigned to SUSLAK; therefore, is ineligible for
entitlement to the JMUA awarded to SUSLAK.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant reviewed the evaluation and states SUSLAK was an
unclassified descriptor used by the U.S. Forces Korea Command
Personnel when referring to this joint and combined DoD unit.
He was tethered administratively to the 6903rd Electronic
Security Group Operating Location FM (OLFM) physically located at
the Yongsan AIN (Army Installation) in Seoul, Republic of Korea.
His daily work space duty assignment for 24 months was physically
located within the SUSLAK compound in Seoul.
One could argue that he could not have functioned as SUSLAK
station chief in the absence of the civilian station chief were
he not assigned to SUSLAK.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of error or injustice to warrant
awarding the applicant the JMUA. Based on his duties as senior
military advisor to the Chief of Station, SUSLAK and as station
chief in the absence of the Chief, SUSLAK, we believe the
applicant has met the criteria for entitlement of the JMUA.
Therefore, his records should be corrected as indicated below.

The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that he was awarded
the Joint Meritorious Unit Award.

Therefore he will be awarded the KDSM and his records changed to reflect such; however, DPPPR recommends award of the JUMA be denied. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
