The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his report of separation (DD Form 214) be
corrected to reflect the awards of the Joint Meritorious Unit Award (JMUA)
(2nd Award), the Korea Defense Service Medal (KDSM), and the Global War on
Terrorism (GWOT) Medal.
2. The applicant states, in effect, that he is entitled to award of the
JMUA (2nd Award), KDSM, and GWOT Medal and he desires them to be added to
his DD Form 214.
3. The applicant provides a copy of his DD Form 214, an awards listing
from Human Resources Command – Alexandria (HRC-ALEX) showing his unit
received two awards of the JMUA, a copy of the message announcing award of
the KDSM, a copy of the orders assigning him to Korea, and a copy of the
message announcing the award of the GWOT Medal.
CONSIDERATION OF EVIDENCE:
1. The applicant, while serving in the rank of Chief Warrant Officer Four
(CW4), served as the Chief, Military Personnel Office Operations of the
509th Personnel Service Battalion in Korea from March 1995 to March 1996.
2. He served with the United States Army Training Mission – Saudi Arabia
as the Chief, Personnel Service Support during the period of 20 February
1999 through 17 May 2000.
3. On 31 May 2002, he was honorably released from active duty and was
placed on the Retired List in the rank of CW4, effective 1 June 2002. He
had served 34 years, 11 months, and 21 days of total active service.
4. DOD Instruction 1348.33 (Military Awards Program) provides, in
pertinent part, that the Joint Meritorious Unit Award was authorized by the
Secretary of Defense on 10 June 1981. It is awarded to recognize joint
units and activities for meritorious achievement or service, superior to
that which is normally expected. Qualifying achievements must be superior
to that which is expected under conditions of combat with an armed enemy of
the United States, a declared national emergency situation or extraordinary
circumstances and should be operational in nature. The Joint Meritorious
Unit Award may not be awarded to any DOD activity which has received any
other unit award for the same achievement or period of service. An oak
leaf cluster is authorized for wear for each additional award of the Joint
Meritorious Unit Award. Department of the Army General Order Number 2001-
25 awarded the JMUA to the United States Military Training Mission – Saudi
Arabia (USAJMTM-SA) for the period of 16 July 1998 through 1 November 1999.
5. Human Resources Command Message (Date Time Group 17 March 2004)
disseminated implementing instructions for award of the Global War on
Terrorism Service Medal. This award is designated for Soldiers who have
participated in or served in support of Global War on Terrorism Operations
outside of the designated area of eligibility determined for award of the
Global War on Terrorism Expeditionary Medal on or after 11 September 2001
to a date to be determined. All Soldiers on active duty, including Reserve
Component Soldiers mobilized or National Guard Soldiers activated, on or
after 11 September 2001 to a date to be determined having served 30
consecutive days or 60 nonconsecutive days are authorized this award.
6. Army Human Resources Command Message (Date Time Group 9 February 2004)
published implementing instructions for award of the Korea Defense Service
Medal. This message specified criteria for the award of the Korea Defense
Service Medal as follows: a) service members of the armed forces must have
served in support of the defense of the Republic of Korea from 28 July 1954
through a future date to be determined by the Secretary of Defense; b) the
area of eligibility encompasses all land area of the Republic of Korea, and
the contiguous water out to 12 nautical miles, and all air spaces above the
land and water areas; c) service members must have been mobilized with
units or assigned or attached to units operating in the area of eligibility
and have been physically deployed in the area of eligibility for 30
consecutive or 60
nonconsecutive days.
DISCUSSION AND CONCLUSIONS:
1. The applicant was assigned to the USJMTM-SA during the period it was
awarded the JMUA. Accordingly, he is entitled to be awarded the JMUA with
one oak leaf cluster and to have that award added to his records.
2. The applicant also served in Korea and on active duty during the
periods necessary to qualify for awards of the KDSM and the GWOT Medal.
However, authorization for those awards were not announced until after his
retirement.
3. Accordingly, it would be in the interest of justice to award him the
KDSM and the GWOT Medals at this time and to add them to his records.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
awarding him the JMUA with one oak leaf cluster, the KDSM and the GWOT
Medal and by adding them to his records.
