APPLICANT CONTENDS THAT: 
 
He served temporary duty (TDY) in Thailand in 1963, and his records do not reflect any Foreign Service. 
 
In support of the appeal, the applicant provides a copy of his DD Form 214, Armed Forces of the United States Report of Transfer or Discharge.

STATEMENT OF FACTS: 
 
The applicant enlisted in the Regular Air Force on 30 Oct 61, and was progressively promoted to the grade of airman first class (E-4).  On 29 Oct 65, he was released from active duty for (Expiration of Term of Service) with service characterized as honorable.  He served a total of four years of active service. 
 
His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, reflects no Foreign and or Sea Service. 
 
On 18 Jun 10, AFPC/DPAPP notified the applicant that his military personnel records did not contain evidence to substantiate that he served overseas.  He was asked to check his personal records for documentation to help support his appeal, but has not responded to their request.

AIR FORCE EVALUATION: 
 
AFPC/DPAPP recommends denial.  DPAPP states a thorough review of the applicant’s military personnel records did not reveal that he served overseas.  A letter was sent to him requesting additional information, but as of this date, he has not provided the requested information.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION: 
 
A copy of the Air Force evaluation was forwarded to the applicant on 6 Aug 10, for review and comment within 30 days.  As of this date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT: 
 
1.  The applicant has exhausted all remedies provided by existing law or regulations. 
 
2.  The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 
 
3.  Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice.  We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice.  Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting his request.

THE BOARD DETERMINES THAT: 
 
The applicant be notified that the evidence presented did not demonstrate the existence of a material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
