RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2009-00760 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States, Report of Transfer or Discharge, be corrected to reflect awards and decorations for his service in Vietnam. _________________________________________________________________ APPLICANT CONTENDS THAT: He believes it was an oversight and he should be authorized the citation and Vietnam Campaign Ribbon for the Vietnam era and it is not reflected on his DD 214. He served and completed a full temporary duty (TDY) tour in Guam and it included a two-week special assignment tour in Utopia, Thailand during 1964 to 1968. In support of his request, the applicant provides copies of his DD Forms 214. The applicant's complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant’s master personnel records were destroyed in the 1973 fire at the National Personnel Records Center; however, available records reflect the applicant was placed on the USAF Retired Reserve List on 31 Jul 99 and became eligible for retired pay on 15 Oct 01. His DD Form 214, issued in conjunction with his 23 Sep 68 discharge, reflects he had three months of Foreign and/or Sea Service. _________________________________________________________________ AIR FORCE EVALUATIONS: HQ AFPC/DPAPP recommends denial. DPAPP states they were unable to locate documentation validating a TDY to Guam or Thailand. Additionally, on 3 Aug 09, the applicant was requested to provide additional documentation substantiating his claim. As of this date, no response has been received. The complete HQ AFPC/DPAPP evaluation is at Exhibit C. HQ AFPC/DPSIDR recommends denial. DPSIDR states they are unable to verify the applicant’s service in Utopia, Thailand. The complete HQ AFPC/DPSIDR evaluation is at Exhibit D. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATIONS: Copies of the Air Force evaluations were forwarded to the applicant on 29 Jan 10 for review and comment within 30 days (Exhibit E). As of this date, this office has not received a response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt their rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice.
