APPLICANT REQUESTS THAT:

He receive credit for his service in Vietnam.

APPLICANT CONTENDS THAT:

Special Order T-1802, dated 15 Oct  65,  supports  that  he  was  sent  on
temporary duty (TDY) to Bein Hoa, Vietnam  in  support  of  Operation  TWO
BUCK.

In support of his request, the  applicant  provides  copies  of  documents
extracted from his military personnel records.

STATEMENT OF FACTS:

The applicant’s records  reflect  that  he  served  on  active  duty  from
29 May 62 to 27 May 66, with five months Foreign Service.  His performance
report for the period ending 31 Aug 63 indicates that he was deployed  TDY
to Thailand for three months, but does not indicate the inclusive dates.

On 2 Feb 11, AFPC/DPAPP informed the applicant they were unable to  verify
that he served in Vietnam for the period in question.  DPAPP requested the
applicant provide documentation,  such  as,  travel  vouchers,  evaluation
reports, letters of evaluation, and decorations, to verify that he  served
in Vietnam during the period in question.

In response to a request for source documentation, the applicant  provided
another copy of Special Order  T-1602  and  his  DD  Form  214.   He  also
provided a copy of his Airman Military Record which reflects he was TDY on
16 Mar 64 for 49 days.  He also stated that he had five months of  Foreign
Service, of which 49 days were in Thailand.  Furthermore, his pay  records
should reflect that he
received combat pay for the time he spent in Vietnam,  while  attached  to
the 429 TAC Ftr Sq, Vietnam.

AIR FORCE EVALUATION:

HQ AFPC/DPAPP recommends  denial  and  states  that  a  review  of  the
documentation submitted and the applicant’s  military  records  do  not
support that he served in Vietnam.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant  on  25
Feb 11, for review and comment within 30  days.   As  of  this  date,  no
response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by existing law or
regulations.

2.    The application was not timely filed; however, it is in the interest
of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice.  The applicant’s contentions are  duly
noted; however, after reviewing the evidence of record, we agree with  the
opinion  and  recommendation  of  the  Air   Force   office   of   primary
responsibility and adopt its rationale as the basis for our  decision  the
applicant has failed to sustain his burden of proof of the existence of an
error or injustice.   However,  his  appeal  may  warrant  reconsideration
should he provide additional documentation showing that he  completed  the
TDY in Vietnam during the period in question, or statements from his chain
of command or fellow service members stating that he was TDY  or  assigned
in Vietnam.  Therefore, in the absence of evidence  to  the  contrary,  we
find no basis to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not  demonstrate
the existence of material error or injustice;  that  the  application  was
denied without a personal appearance; and that the application  will  only
be reconsidered upon the submission of newly discovered relevant  evidence
not considered with this application.
