APPLICANT REQUESTS THAT:
Her DD Form 214, Certificate of Release or Discharge from Active Duty, be
corrected to show she was on active duty while attending Officer Training
School (OTS) from 6 January 1998 through 23 April 1998.

APPLICANT CONTENDS THAT:
Her DD Form 214 does not include her initial service when she attended OTS
in the grade of E-5.
In support of her appeal, the applicant provides copies of her enlisted and
commissioned DD Forms 214, enlistment and separation documents.

STATEMENT OF FACTS:
Applicant enlisted in the Regular Air Force in the grade of staff sergeant
(E-5) for the purpose of attending OTS. She graduated on 23 April 1998 and
received her commission on 24 April 1998. She was progressively promoted
to the grade of captain effective and with a date of rank (DOR) of 24 April
2002. She was released from active duty on 4 July 2002 after having served
for 4 years, 2 months, and 11 days.
She received a DD Form 214 when she was released from active duty as an E-
5. She received another DD Form 214 for her commissioned service. Both DD
Forms 214 are considered correct representation and accounting of her time
in the Air Force. She received one for her enlisted duty and one for her
commissioned duty as they are considered two separate and distinct periods
of service under different categories.

AIR FORCE EVALUATION:
The Air Reserve Personnel Center received this case for an advisory opinion
on 25 November 2008 and has failed to provide one.

THE BOARD CONCLUDES THAT:
1. The applicant has not exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we are
unconvinced an actual error or injustice has occurred in this case. At
separation, service members are issued a DD Form 214 documenting their
active duty service for that time period. Subsequent periods of active
duty are accounted for on additional DD Forms 214 at the time of separation
from the service. In the applicant’s case, she served in an enlisted
capacity while attending Officer Training School (OTS). Upon completion of
OTS, she was separated from the AF as an enlisted member and appointed in
the Air Force as an officer. Additionally, her contention that her
enlisted time while attending OTS has not been accounted for is without
merit as her second DD Form 214 displays that time in block 12d, Total
Prior Active Service. Consequently, both of her DD Forms 214 appear to be
correct. Therefore, in the absence of evidence to the contrary, we find no
compelling basis to recommend granting the relief sought in this
application.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
