APPLICANT REQUESTS THAT:

She be awarded the Afghanistan Campaign Medal (ACM) and  the  Iraq  Campaign
Medal (ICM).

APPLICANT CONTENDS THAT:

These medals were not awarded prior to her separation from  active  duty  in
2004.  She submits her  Officer  Performance  Reports  as  evidence  of  her
service to qualify for these medals.  She needs  these  medals  awarded  for
Veterans of Foreign Wars (VFW) eligibility.

In support of her request, the applicant provided copies  of  her  AF  Forms
707B, Company Grade Officer Performance Report (2LT thru CAPT).

Her complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Applicant’s military personnel records reflect she was commissioned  in  the
Regular Air Force on 13 July 1999.

During the period in question, she participated in both  Operation  ENDURING
FREEDOM (OEF) and Operation IRAQI FREEDOM (OIF).

The Directorate of Assignments (AFPC/DPA) confirms  that  she  completed  18
missions during OEF and 19 sorties  during  OIF.   AFPC/DPA  also  confirmed
with the Defense Finance Accounting Service that she served in  the  country
of Oman in support of OEF and OIF  from  February  2002  to  July  2002  and
December 2002 to April 2003.

On 31 July 2004, she was honorably discharged in the grade  of  captain  (O-
3).

She served 5 years and 18 days on active duty.

The ICM and ACM are awarded to service members assigned  or  attached  to  a
unit participating in the area of eligibility for 30 consecutive days or  60
nonconsecutive days in the  countries  of  Afghanistan  and  Iraq  or  while
participating as a regularly  assigned  aircrew  member  flying  sorties  in
direct support of OEF/OIF; each day that one or more sorties  are  flown  in
accordance with these criteria  shall  count  as  one  day  towards  the  30
consecutive or 60 nonconsecutive day requirement.

AIR FORCE EVALUATION:

AFPC/DPSIDR  recommends  denial.   DPSIDR  states  in  accordance  with  the
141745Z April 2005 message  from  HQ  USAF  Washington,  DC/DPPFC,  the  ACM
inclusive period is 11 September 2001 to a date  to  be  determined  (DTBD);
the ICM inclusive period is 19 March 2003  to  a  DTBD.   The  message  also
specifies regularly  assigned  air  crewmembers  flying  sorties  in  direct
support of these military operations earn a day of eligibility for each  day
of the operation.  To verify entitlements,  the  applicant  provided  flying
documentation to support her claim to the  ACM  and  ICM  based  on  sorties
flown while serving in support  of  OEF/OIF.   Based  on  a  review  of  her
military record, DPSIDR is unable to confirm she met the  required  criteria
for award of both the  ACM  and  ICM.   Without  official  documentation  to
confirm she  performed  at  least  30  missions  in  each  campaign,  DPSIDR
recommends disapproval for these awards.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded  to  the  applicant  on  23
December 2008, for review and response.  As of this date,  this  office  has
received no response. (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of an  error  or  injustice.   After  a  thorough  review  of  the
available evidence and the  applicant’s  complete  submission,  we  find  no
evidence, that her records should be corrected to show she was  awarded  the
ACM or ICM.  As such, we agree with the opinion and  recommendation  of  the
Air Force office of primary responsibility and adopt its  rationale  as  the
basis for our conclusion that the applicant has not been the  victim  of  an
error or injustice.  Should she secure supporting documentation showing  she
completed the required number of sorties, we would be willing to  reconsider
her application.  In the absence of persuasive evidence to the contrary,  we
find no  compelling  basis  to  recommend  favorable  consideration  of  her
application.

RECOMMENDATION OF THE BOARD:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of an error or injustice;  that  the  application  was  denied
without a personal  appearance;  and  that  the  application  will  only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
