He be awarded the Bronze Star Medal (BSM).

STATEMENT OF FACTS:
A similar appeal was considered and denied by the Board on 24 October
2008. For an accounting of the facts and circumstances surrounding the
rationale of the earlier decision by the Board, see the Record of
Proceedings at Exhibit F.
By letter, dated 5 November 2008, applicant requests reconsideration of his
request, contending that his commander submitted a recommendation for the
award of the BSM and that he was selected to receive the BSM award.
In support of the appeal, applicant submits a personal statement and a copy
of Part II Monthly Maintenance Data Analysis reports.

THE BOARD CONCLUDES THAT:
In an earlier finding, the Board determined there was insufficient evidence
to warrant any corrective action. After thoroughly reviewing the
additional documentation submitted in support of this appeal and the
evidence of record, we do not believe the applicant has overcome the
rationale expressed in our previous decision. Therefore, in view of the
above, and in the absence of evidence to the contrary, we find no basis
upon which to recommend favorable consideration of the applicant’s request.
The applicant's case is adequately documented and it has not been shown
that a personal appearance with or without counsel will materially add to
our understanding of the issue involved. Therefore, the request for a
hearing is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the additional evidence presented did not
meet the criteria for reconsideration by the Board; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
