APPLICANT REQUESTS THAT:

His records be corrected to reflect that he was awarded the  Korean  Defense
Service Medal (KDSM) and the Southwest Asia Service Medal (SWASM).

APPLICANT CONTENDS THAT:

The KDSM is a new award and he  should  receive  one  for  his  time  served
during the period of Sep 98 through Sep 99.   He  was  stationed  in  Turkey
from Sep 96 through Sep 98 and should receive  the  SWASM  for  his  service
during that time.

In support of the application, the applicant submits a copy of his  citation
and Special Order G-025 for the Air Force Achievement Medal for  the  period
of 29 Sep 98 to 9 Sep 99.

The applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Applicant was honorably discharged on 14 Mar 01.  He had served 6  years,  9
months and 14 days on active duty.

Applicant’s entitlement to the KDSM has been verified and his  records  will
be updated accordingly.

The remaining relevant facts pertaining to this application, extracted  from
the applicant’s military records, are contained in the  letter  prepared  by
the appropriate office of the Air Force at Exhibit C.

AIR FORCE EVALUATION:

HQ AFPC/DPSIDR recommends denial of the SWASM.   Applicant  was  permanently
assigned to Incirlik AFB, Turkey, from 1996  through  1998.   DPSIDR  states
the SWASM was not awarded after 1995.

DPSIDE  also  notes  the  applicant  is  not  entitled  to  the  Air   Force
Expeditionary Medal (AFEM) DUE TO BEING  ASSIGNED  TO  Turkey  in  permanent
party status and not deployed status.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:


A copy of the Air Force evaluation was forwarded to the applicant on 27  Jun
08 for review and comment within 30 days.  As of this date, this office  has
received no response (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  The applicant has  not  provided  evidence
to prove he meets the criteria for receipt of  the  SWASM.    Therefore,  we
agree with the opinion  and  recommendation  of  the  Air  Force  office  of
primary responsibility  and  adopt  its  rationale  as  the  basis  for  our
conclusion that the applicant has  not  been  the  victim  of  an  error  or
injustice.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
