APPLICANT REQUESTS THAT:

His records be corrected to reflect that he served 20 years of  active
service.

APPLICANT CONTENDS THAT:

He was medically retired at 19 years and 8 months of  active  service,
just short of having 20 years of service.

In support of his application he submitted a copy of his DD  Form  214
and his retirement order.

Applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Applicant contracted his initial enlistment in the Regular  Air  Force
on 13 Feb 48.  He was progressively promoted to  the  grade  of  staff
sergeant having assumed that grade effective with a date of rank 1 Apr
53.  On 25  Feb  66  he  was  medically  retired  with  a  50  percent
disability rating.

AIR FORCE EVALUATION:

AFPC/DPSD recommends denial.  DPSD states service members are eligible
for Concurrent Receipt Disability Pay (CRDP) if they have 20  or  more
years of active service.  The applicant does not have the required  20
years of active duty service to apply for the CRDP.  The  evidence  of
record does not reflect that an error or an injustice occurred  during
the disability process or at time the of separation.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 27 Jun 08, a copy of the Air Force evaluation was forwarded to  the
applicant for review and comment within 30 days.  As of this date,  no
response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt its rationale as the  basis
for our decision that the applicant has failed to sustain  his  burden
of proof of  the  existence  of  either  an  error  or  an  injustice.
Therefore, in the absence of evidence to  the  contrary,  we  find  no
compelling basis to recommend  granting  the  relief  sought  in  this
application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
